Remember when Lindsay Lohan clipped a baby? The baby’s nanny is suing.

Remember back in 2010, when Lindsay Lohan was fresh out of jail/rehab/something, and she had gotten her hot little crack hands on a shiny new Maserati, and within days, she nearly ran over a nanny and a baby in a stroller? Go here and here for the recap – initially, the story was that the Cracken was obviously too cracked-out and entitled to look both ways before making a right on a red. She didn’t see the nanny (with the baby in a stroller), and she clipped them. Radar claimed she didn’t even stop – she just kept on driving. When Radar approached Camp Linnocent about the incident – which was witnessed by paparazzi! – she claimed, “I don’t know what you’re talking about.” Then, hours later, TMZ magically had a different version of events – they claimed that LL had made a turn on a green light, that the nanny did not have the right of way, so obviously, the Cracken had every right to clip her and the stroller. TMZ also claimed that LL DID stop the car and ask the nanny if she was alright, and then she sped off.

No charges were ever filed in the incident, although it definitely stuck with me as one of LL’s nastier moments (in a lifetime full of nastiness). Well, as it turns out, all has not been forgotten! The nanny who got clipped is now suing LL:

After a relatively drama-free 2012 so far, Lindsay Lohan could find herself back in court soon after a woman has filed a lawsuit against her in connection with a car crash, and RadarOnline.com has the legal documents with details of the accusation.

Nubia Del Carmen Preza was allegedly pushing a stroller across an intersection in West Hollywood in September 2010, when the Mean Girls star flew down the road in her Masserati and hit the nanny, catapulting the baby carrier into the air.

The child wasn’t hurt but Preza is claiming injuries, according to legal papers filed with the Los Angeles Superior Court on Wednesday.

Also named in the lawsuit is Black And White Car Rental, the company that provided the troubled actress with the Masserati Granturism that she was driving at the time of the incident.

According to the papers, the “Plaintiff hereby requests a trial by jury.”

As RadarOnline.com previously reported, Lohan was last in court earlier this month for a progress report related to her probation for separate drunken driving and shoplifting cases, where she recieved a glowing report from Judge Stephanie Sautner.

TMZ’s version is similar, although now they seem to acknowledge that LL did in fact run a red light, so the nanny probably did have the right of way. A witness to the incident told TMZ that the nanny “was in shock and Hispanic so she was scared.” Edit: Some of you are wondering about the “Hispanic” comment – I didn’t make it, and I don’t know what it means. My guess is that the “witness” to the incident assumed the nanny was an illegal alien, and thus, she didn’t want to get law enforcement involved.

Look – you know how much I would love to see this crackhead sued into oblivion and thrown into jail. But that’s just not going to happen with a 2-year-old car accident in which no complaint was ever filed in real time. Don’t get me wrong, I believe LL clipped a baby, I believe she drove away without caring, I believe she was probably high as a kite at the time of the incident. But I also believe this nanny is probably just looking for a payout.

    What does the nanny being Hispanic have to do with anything? Weird. Agree about the payout – though I don’t feel bad for The Cracken. Nanny for the win! Consequences, Cracky, finally. Sick of her getting away with everything us ‘regular’ people wouldn’t.

      I know – it’s so poorly stated and racist. Like she’s ‘Hispanic’, so she probably didn’t speak any English and was intimidated and was probably an illegal immigrant. Being Hispanic doesn’t always imply the above, how unlearned.

      I think it’s really strange TMZ pointed that out too. I think they meant she was nervous because she can’t speak English fluently, but they worded it poorly and made it sound antiquated/racist.

        @ Morticians – me too. My mom is Spanish and her family has been here for centuries, yet because she speaks some Spanish and has dark coloring people assume she just came to this country. (OTOH, no one believes me when I tell them that I’m half Spanish, since I have my dad’s Irish coloring and complexion.)

      It’s mentioned because the subtext is that she’s an illegal alien and didn’t come forward before now because she was afraid of being caught out in her illegal status. Thus, she “couldn’t” come forward. Why did she come forward now? Well, it IS interesting that Lindsay did just recently come into a million Playboy dollars.

        That’s what I took from it as well. The angry racial responses to this were a bit melodramatic in this case, I think. I didn’t get anything from the text except an attempt at tactfully stating she had not come forward before because she was illegal, and now she could.

        And…I hope she nails that little crack head to the wall in court. She hit this woman and a baby with her car and kept driving. Why this bi*** hasn’t yet found herself in prison for one of her many felonies is beyond my comprehension. This “Hispanic nanny” was one of her victims, and she should be compensated. I’m pretty sure I’d want to sue someone who hit me with a car if the police did nothing to punish them. Damn skippy.

      I have to agree! It must have frightened the poor woman to death! And it’s odd that the media claimed that the nanny was in the right, then Lohan, and now the nanny again. I believe the nanny over Lohan. I’m not sure that I believe that Lohan ever stopped and checked the woman and baby, either. She might have, but I’m skeptical.

      I truly wondered why this story just disappeared because it, along with the carjacking, were the most disturbing actions of Lohan’s. She should have been jailed for the carjacking. I guess if the nanny was illegal, it explains why she was quiet for so long.

      And I hope that the nanny did incur a few “injuries” and that the statute of limitations hasn’t already expired. That Lohan clipped a baby carriage 9and perhaps the nanny, too) is repugnant. She’s gotten away with some lawless behavior before but harming someone with your car takes the cake. I hope the book is thrown at her for this one. Hey, I hope the baby throws the book at her too.

        The law is a year in most states, so 2 years later, I seriously doubt anything is going to be charged on Fag-Ash Lohan.

    Id sue too if anything that LL touched touched me.
    She may have been trying to collect medical damages before this but LL being the grifter she is probably never paid. Maybe this is the nannies last resort to recoup the cost of medical bills and lost wages. She wouldnt be the first one that had to resort to a law suit to get whats owed to her from LL, she has a documented history of not paying her debts but some how finds a way to settle them after a lawsuit has been filed.

      It’s obviously not a phobia of automobiles, it’s a phobia of the law intervening. But now that Lohan has a good chunk of change, maybe the nanny’s gotten up the fortitude to file suit, and good for her Whether or nor the nanny was seriously injured, Lohan has some nerve blowing through a red light and clipping a baby carriage. She COULD have killed or seriously injured either or both of the pedestrians and I’m SURE that she frightened the nanny half to death.

    What a strange description by implying that because the nanny is hispanic she cant speak english – anyway, I am surprised by this – I thought the statute of limitations in california for this type of personal injury was 1 year.

    I know it is hard to believe, but I could be wrong! ^_^

      Statute for PI in California is two years. Legislature increased it to two a number of years ago. She probably didn’t reach a settlement with the insurance carriers.

    Lilo needs to move out of LA/NYC, go to another country or state with little technology, away from the paparazzi, let her red hair grow back, get some new friends, take some acting classes,and then she can finally get her career on track again. But in reality that is probably never going to happen at this point. I have a feeling she is going to screw up again and end up in jail or something or maybe have a mini career boost then screw up again who knows?

      Honestly, I think this about any number of celebrities. Why don’t they all pull a Sandra Bullock (not in *any way* comparing her to LiLo) and move somewhere that they can live normal lives, have normal relationships, let their kids have normal friends. They’d still be fabulously wealthy with the personal satisfaction of hard word & success.

    I feel badly for the nanny and kid, but not going to the police but filing a civil suit doesn’t sound too great.

    Legally, it doesn’t matter if the light was red or green. Pedestrians always have the right of way, regardless of whether or not the little glowing white man or walk sign is lit. Drivers are responsible for seeing and preparing for any obstacles in the road, not the other way around. Linnocent needs to be taken to task for something she’s done and this’ll do for me.

      I guess it could have some importance in a criminal case if you were in the right and accidentally clipped someone versus they jaywalked in front of you. Yes, you are always supposed to give pedestrians the right of way but she might have some legal wiggle room if she was found to be following the traffic laws (and we all know how likely that is.)

        Whether the crosswalk is (clearly) marked or not, pedestrians DO have the right of way at the corners and intersections (unless posted otherwise).

        However, in the middle of the block, when there is no crosswalk, it is implied that they are not to cross there (jaywalk) and are therefore breaking the law.

        Yes, they do. If someone darts out in front of you, you might have a case but in almost every instance, regardless of extenuating circumstances, a pedestrian has the right of way. I’ve argued and won in court for more than one client for this exact offense. It doesn’t mean the jay-walker is relieved of fault. It means that drivers should always be prepared for distractions. It’s the same idea as being at fault when you rearend someone. Yes, the person in front of you should practice safe driving but you, from behind, are always expected to be able to safely stop.

      I also noticed, that the girls were looking at Lindsay’s feet. I didn’t wonder so much about the fact that she has sagging breasts in her 20s (it’s genetic, some have perky breasts even in her 50s, others (esp. if they have big breasts) start very early to sag). What came to my mind immediately was her Playboy-Pictorial… If my memory serves me correctly, her girls looked very different in those pictures. Well Lindsay, Playboy can’t photoshop ALL of your pictures, can they?

    I want to start off by saying that it was in no way right for Lindsay to clip a baby and that she should definitely have her license taken away.
    That being said, I disagree with Linney. The walk and don’t walk lights are there for a reason: to let pedestrians know when it’s safe to walk. We’re taught to look both ways before crossing the street, even at crosswalks, because some drivers don’t look for pedestrians and will turn anyway, regardless of right of way rules.
    Also, I don’t know if anyone else commenting here lives in southern CA, but I have my whole life. All my life, I’ve seen Hispanics cross the street without looking for cars or at the traffic lights, many times not in the crosswalk, or even anywhere near the corner, enough times for me to say most of them are like that. Lindsay’s still in the wrong, but I’m saying it’s possible the nanny just walked into the street without looking at the lights or for cars. Call me racist if you want; I’m just stating my observations of over two decades across three counties.

There are exceptions to the law but I sincerely doubt Linnocent falls within any of them. Bad driving is just one of her bad habits. Also, you want law? Avoid Wikipedia as your source.

    My feelings about Lindsay aside – I don’t get people who decide to sue years after an incident. Strikes me as dishonest somehow. If you are that put upon when the incident happens, you should just sue then. Why wait 2 or 3 years? I don’t get it.

      Maybe Lohan had no money 2 years ago. What would be the point of filing a lawsuit (not to mention getting a lawyer to take it on) if the person being sued is broke? What would you gain? Lawyers taking on these types of cases typically don’t get paid until they win, and then they get a 30 percent cut, or something in that range. Obviously they aren’t gonna give you the time of day if you’re trying to sue a broke person.

    I can see not filing until later. Sometimes we think we’re okay until the next day or two. Then, a year or two into the injury, we realise we’ve suffered permanent damage. (I never filed a worker’s comp claim when I was 16 & hurt my upper-back pushing carts. That was nearly 30 years ago, and I still have problems with it to this day.)

      Also, sometimes it takes that long to get your lawyer in place, get your courage up because you know you will be dragged through the mud, etc.

      I have been there, took my over a year to get all my evidence, write up my statements, etc. It’s only been a little over a year, not closer to a full 2.

      Also, if she was or is sending money to her home country to support family, she couldn’t afford to lose her job. Compared to the money they make, the money she made being a nanny made really helped the family alot.

    Lindsay is the first one holding her hand out for any money she can beg, borrow, steal, or sue from innocent people–if others find legal ways to do it right back to her, I applaud them. She deserves every lawsuit–frivolous and otherwise–that she gets served.

    The only way the Hispanic comment makes sense is if she couldn’t speak English. Like, if there was a language barrier or something. Beyond that…I don’t really know what else it could construed as.

    I think if the nanny is suing now because there has been some sort of injury that has been going on she could have a case. I’m not scrolling up because my computer is lagging, but if it is within two years, she still has a case. It may not go very far, but it will do something. But I don’t know if it will get the pay off she thinks if that is all she wants.
