Lee Daniels agreed to pay Sean Penn’s legal fees in Penn’s defamation lawsuit

Many outlets have been covering the rumors that Sean Penn and Madonna are maybe back together. Penn keeps on showing up at Madonna’s concerts, and they really do seem legitimately close these days. It’s interesting timing, given the long-standing rumors about Penn allegedly abusing, threatening and assaulting Madonna back when they were married. The rumors are so long-standing that many people assume they are 100% accurate. Lee Daniels believed they were accurate.

In discussing Terrence Howard back in September, Daniels told THR: “That poor boy. [Terrence] ain’t done nothing different than Marlon Brando or Sean Penn, and all of a sudden he’s some f—in’ demon. That’s a sign of the time, of race, of where we are right now in America.” As in, if Terrence Howard was a white guy like Sean Penn, Howard would be able to get away with being a serial abuser of woman (not to mention the fact that Howard is batsh-t crazy). Anyway, Sean Penn got mad and he’s suing Daniels for defamation. So far, not a lot has happened but both Penn and Daniels are all lawyered up now, and some legal stuff is percolating:

Just over a week after the Empire co-creator tried to get Sean Penn’s $10 million dollar defamation lawsuit against him moved to federal court, Lee Daniels has today backed down and paid out, it seems.

“Having considered the arguments and authorities raised in Penn’s October 22, 2015 pre-motion letter requesting a remand and having diligently met and conferred, Daniels has agreed to withdraw his Notice of Removal, and to have this matter remanded to the Supreme Court of the State of New York,” said a letter from Daniels’ lawyers filed today in federal court. “Further, the parties’ resolution includes Daniels’ payment of a confidential monetary amount to Penn consistent with the guiding principles” of the U.S. Code, it adds.

While no dollar amount was given, sources tell me that the payment by Daniels was for Penn’s legal fees, as the Oscar winner’s primary attorney Mathew Rosengart requested on October 22. A proposed order to Judge Edgardo Ramos was submitted today as well formally moving the matter back to the N.Y State courts.

Citing that Penn lives in California and he resides in New York, Daniels submitted a request for removal in both the NY Supreme Court and federal court on October 21. This was their first response to the Mystic River actor’s September 22 multi-million dollar complaint based on an interview Daniels gave implying Penn abused women.

A day later Penn’s lawyer hit back pointing out that the federal statute doesn’t let a civil action be shifted to another court if the defendant lives in the state where the initial suit has been filed – as Daniels does. Before today’s resolution, the two sides were scheduled to go head-to-head in Judge Ramos courtroom on November 10. Now they are saving their powder for state court.

As in… nothing has really been resolved, but Daniels’ legal team seems to be coming in weaker than expected, and they’ve already agreed to pay Penn’s legal fees. Usually – it seems to me? – that’s the kind of thing that would be worked out AFTER you go to court, or after you reach some kind of out-of-court settlement. Personally, I don’t think either Penn or Daniels are coming from a place of strength, and it wouldn’t surprise me if both sides are able to work out some kind of deal in which Daniels, say, donates $1 million to Penn’s Haiti charity and offers some kind of public statement/apology to Penn.

    Why would Penn want to open that can of worms. Considering how his last relationship ended, why would he want to go there.

    Isnt the abuse public record?? Maybe im mistaken but its not like Daniels made it up…hollywood loves to pretend their beloved entertainers never commit horrendous crimes/let them get away with b.s but us plebeians never forget…

      That’s what I thought. Daniels is hardly the first person to talk about it, and it’s not like it was some big secret he revealed. Everyone knows about Penn.

      Liberace sued a publication for gay allegations. I think the lesson here is for Lee to keep his mouth shut from now on. Or if your going to bitch to the press try not to use names.
      But then Daniels seems to be at war with a lot of people so I’m sure he has his lawyers on speed dial.

    Meh…Daniels had a point about the race factor, to be sure, but he doesn’t know what happened with Penn, so he spoke out of school. But I believe Penn is awful, for the record. Abusive and explosive through to the core.

    And Terrance Howard, regardless of his success did need to be called out and held accountable like all the abusers who’ve gotten passes before him.

    Just a little insight from the legal system for you: he’s not paying all the legal fees, he’s paying those related to the motion to transfer. Daniels withdrew the request to transfer, which means he’s (rightly) on the hook for some costs. It has nothing to do with the merits of the actual case. Final costs awards will be decided much later.

      Thank you. It’s pretty clear this payment is only in relation to a wrongly filed motion on Daniels’s part.

    Think it will resolve along the lines suggested in the article. Who actually believes Madonna will sit for a deposition? And if this proceeds, that’s exactly what would have to happen.

    Meh. Lee stood up for a serial abuser of women. Don’t stand up for a serial abuser of women, Lee. It doesn’t look good. You just don’t keep racking up all of these allegations of abuse on females without truth being there. The guy is in a hit TV show. It’s not like he’s being ostracized or career destroyed, now, is it?

    “The allegation: In August of 2000, Howard was arrested in Cleveland after assaulting a flight attendant on Continental Airlines when she told him to return to his seat while the seat belt sign was on.
    Howard’s defense: Howard says he was just trying to take his daughter to the bathroom, and charges were dropped by the Cleveland District Attorney for lack of jurisdiction/

    “The allegation: Less than a year after the Continental incident, Howard was arrested in Whitemarsh, PA for assaulting his estranged wife, Lori McCommas. An argument over the phone led to Howard driving over to McCommas’ home, kicking down her front door, and punching her three times in the face.

    “The allegation: Howard married his second wife, Michelle Ghent, on January 20, 2010. It took less than a week for the alleged violence to begin. Ghent filed for divorce in January 2011, and the divorce papers detail a gruesome year: a slug in the face a week into the marriage, a beating and near-toss off a balcony in South Africa in July, and threats with a butcher knife in the week prior to her filing for divorce. The abuse apparently continued as Howard and Ghent tried to reconcile.

    “The allegation: On May 6, 2012 Howard’s on again-off again girlfriend/mistress May Seng Yang alleged that during an argument at Howard’s Pennsylvania home, Howard attacked her while his current girlfriend, Erica Jiles looked on. Yang “told Whitemarsh police that Howard had choked her, thrown her to the ground and punched her in the eye, then told his girlfriend, ‘Fuck this, I’m going to jail for this tonight.’ In a handwritten statement to police, Yang wrote that during their argument she told Howard that he had given her herpes and says he acknowledged doing so.”

    “The allegation: Howard and Ghent recently took another shot at a reconciliation, taking a trip to Costa Rica together August of 2013. Ghent alleges that Howard punched her in the face, after she told him she didn’t think a reconciliation was going to work out, forcing her to pepper spray him in self defense. The photos are damning. A judge has granted Ghent a temporary restraining order.”

      Nobody in this equation looks good. Sean Penn and Terrence Howard look bad because of their domestic violence histories. Lee Daniels looks foolish for defending Howard.

    Yes, truth is a defense.

    The Madonna stuff is public record, probably with LA County.

    Equating Penn with Brando is not much of a stretch, probably a great analogy, actually. Except I still keep a place for Brando in my affections, he had a terrible childhood, alcoholism, and lots of tragedy in his life but incredible talent.

    Shame on Lee Daniels for defending domestic abuse, he really ought to know better, him of all people.

    Lee Daniels lost me on this. So if others are dirty, why punish just Terrance. Abusive men are deplorable.

    #Team noone but hopefully Lee Daniels will learn to keep his mouth shut and choose his battles ,(this was not it ) . Painting a known douche like Terrence as a “poor boy” and using the race card to defend an alleged abuser who clearly hasn’t been hurting for work despite numerous allegations is beyond tacky
