The Heritage Foundation has been on a two-year-plus fishing expedition to get their hands on Prince Harry’s visa records in the United States. Their entire “case” hinged on “did Harry lie in his visa application?” NOT: “we have evidence that he might have lied” – Heritage’s FOIA request and two-year harassment campaign was solely based on vibes. Even their right-wing allies had grown tired of Heritage’s targeted hate campaign. When the judge on the case ruled, a few days ago, that Harry’s visa records would “finally” be released, it was clear even in the British tabloid reporting that the records would be heavily redacted. That didn’t stop the American, British and Australian media from hollering “Harry could be deported” at the top of their lungs for the past two years. Well, here we are. The records were released. They are HEAVILY redacted, but the Trump DHS lawyer was clearly unamused that Heritage has continued to pursue this BS. From the Mail’s coverage:
Claims that Prince Harry received special treatment when he emigrated to the United States are false, the Trump administration said Tuesday. A lawyer from the Department of Homeland Security said that Harry’s application followed all the ‘applicable rules and regulations’.
The statement was made in heavily redacted documents that were made public on Tuesday after a lawsuit by the Heritage Foundation, a right-wing think tank, which was seeking to prove that Harry lied about his drug use on his visa papers. But despite a judge vowing to release as much material as possible, Harry’s actual immigration file has remained private. The six documents that were released contain page after page of blocked out type, meant to protect Harry’s privacy and stop him being subjected to ‘harassment’.
The partial release of the material will be met with relief by Harry as it appears to be the end of a case which began last year when Heritage sued DHS – and led to speculation the Duke might be deported by Donald Trump. DHS had refused a Freedom of Information request from Heritage for Harry’s visa files on the grounds that he may have lied about whether or not he was a drug user.
The released documents include a declaration from Jarrod Panter, chief FOIA officer at DHS, who said that the agency determined it was not possible to release ‘any portion’ of Harry’s records as anyone with a familiarity with immigration law could easily determine Harry’s status. The Duke, 40, has not publicly revealed his status in the US after immigrating in 2020 with his wife Meghan Markle, 43, with whom he has two children.
Panter wrote that US immigration ‘routinely protects from disclosure the nonimmigrant/immigrant status sought by third parties who do not have permission from the beneficiary to receive this information’. He said: ‘To release such information would potentially expose the individual to harm from members of the public who might have a reason to manipulate or harass individuals depending on their status in the United States’.
Making such information public could subject Harry to ‘reasonably foreseeable harm in the form of harassment as well as unwanted contact by the media and others’. Panter rejected the idea that Harry had been given ‘preferential treatment’. He wrote: ‘This speculation by (Heritage) does not point to any evidence of government misconduct. The records, as explained above, do not support such an allegation but show the regulatory process involved in reviewing and granting immigration benefits which was done in compliance with the Immigration and Nationality Act and applicable rules and regulation’.
Panter’s declaration contains a seven page long list of documents that were identified in the case – but all of them are redacted.
I know a lot of Sussex fans are super-clever, so I hope someone makes a video of all of the redacted documents with the recorder-version of “My Heart Will Go On.” All of this time, money and effort just to get a bunch of blacked-out pages released publicly. Of course, it wasn’t’ solely about getting their hands on an immigrant’s documents – it was about harassing Harry and creating a toxic environment around Harry, all to provide a storyline for the British press. Pathetic. A total embarrassment.

Makes sense now why Harry never once bothered to lift a finger to even talk on this in the media through sources or his own lawyer. The reality: he’s 5th in line to the throne and if his father passes, moves up to 4th + his kids being in the top as well. That’s close and will remain so for at least another 20 years… and yeah, I’m sure it does come with diplomatic perks, ie. gaining living access to pretty much any country in the western world if you choose.

Harry obviously used the best lawyers possible. Did they really expect to find errors or lies? MAGA doesn’t get their ignorance is limited to them.
Of course they aren’t going to release any of this, it’s first good policy as a general matter, but the precedent that would be set by this type of unsubstantiated fishing expedition would not bode well for Melania, her parents, or Elon. Plus, just to be clear, for many other people! DHS took exactly the right decision and I’m not really implying that they did so to block similar inquiries of Trump’s people, just that that is a reality of this type of thing.
Ding ding ding. DHS was smart enough to realize this would set a precedent that would be bigger than Harry. They knew as dumb as this was, that there are absolutely 10000% folks who would have done exactly this for Melania, Elno, and their ilk and knew they needed to quash it. Maybe the first smart thing this administration has done, even if it’s ultimately about protecting themselves.
Trump must really be into his citizenship-for-cash scheme. It would have been DOA if they had released Harry’s unredacted records.
The way Panter not only shut this down but specifically called out the Heritage Foundation (as well as those unmentioned in the British establishment) about the fevered pursuit of these records, is interesting.
He acknowledges in his declaration that releasing any portion of these records would bring material harm to Harry.
And there it is. That’s the real reason the press and UK-connected in the HF cabal wanted these records: they want Harry to feel as unsafe in the US as his father Charles has worked to make him feel unsafe in the UK and other Commonwealth countries where Chuck is head of state. Begs the questions, What did Charles know about this 2 year gambit of idiocy, and when did he know it?

The Heritage Foundation is a conservative think tank that’s been around since the 1970’s. It’s been very influential in policy-making with every administration since then. Oddly enough, they championed Obamacare, and now they’ve developed Project 2025.
Nile Gardiner, who is the pest harassing Harry, is not the president of HF – he’s the director of a project within the HF, called The Margaret Thatcher Center for Freedom, which is supposed to be about maintaining and strengthening the bonds between the US and the UK. Maybe going after Harry is a way to “strengthen” the bonds with the RF – I don’t know. But, the HF is a charitable organization and if I were a donor or a trustee, I’d be pretty annoyed with them spending a pantload of legal fees on a wild goose chase.

Gardiner is a Brit and former Tory worker who worships Thatcher and runs their “Margaret Thatcher Institute”. There is a noticeable movement among some right wingers in the US to elevate the British royals as a white royal family to aspire to, driven in part by him and Heritage. He’s also just a press lackey so he’s doing his friends in the British tabloids a favor.
I’m confused CB lawyers help me out. Does the application ask about past drug use? When I have applied for jobs, it asked if you have ever been convicted of a crime not have you ever used drugs. I would assume these applications are the same?
It does not!
Someone said on previous articles that it asks about if you had a problem with drugs, like addiction type of question. I didn’t fact-check, but Harry talked about experimenting with drugs, not any type of addiction. So, yeah, there is no have-you-ever used any drug question.

You can actually download and read the questions on most immigration applications on the USCIS website. You can find the visa application forms people use when applying for visas at U.S. consulates on the State Department’s website. Google “sample DS-160” or “sample DS-260” to see the visa applications for nonimmigrants and immigrants, respectively.
The short answer is that yes, the U.S. asks people about prior arrests, charges, and convictions as well as drug addiction, BUT whether you will be barred from getting a visa depends heavily on when, where, and what you did and whether a waiver is available. Harry was never convicted of any drug crimes anywhere. He was never a drug addict nor was he legally committed for rehab. Even so, his marriage to a U.S. citizen and father of a U.S. citizen child would make him eligible for a full range of waivers.
And while I think the Heritage Foundation will forever argue that they were making a point about our immigration system by going after Harry, let’s be honest: they were more furious that his Black American wife was able to sponsor him for a green card. They demonize immigrants, but their racism against Black people is equally vitriolic.
Finally, I could have told the Heritage Foundation this was a no go from the start. Immigration files are not subject to FOIA – that’s immigration law 101. But they had to be jacka$$e$.

Apparently Harry’s immigration records were never going to be made public. So the media put out misleading reports. I saw Nile Gardiner on Talktv still insisting that it was in the public’s interest to see Harry’s papers. My guess is Harry was never required to answer about taking drugs and if there was a question it was probably asking if he had drug convictions which he doesn’t. This case just shows the lengths the British press will go to harass Harry and their desperation to break up family and foe him to return to the UK.
The government didn’t fight this for Harry. It’s a win for shady immigration decisions as much as it protects individual privacy.
Immigration has wide discretionary powers to grant our not grant a visa or citizenship.
These were not even the Visa documents! They were transcripts of the Court Hearing which DISCUSSED the Visa. Like others have said, it would have set a precedent for any old Tom, Dick and (no pun intended) Harry, to use FOIA and get access to private individuals’ private information if THF had been allowed access. The trolls just keep on getting their hopes up and getting their feelings hurt. Long may it continue!

Just saw a fascinating thing, which others have sometimes referred to but hadn’t ever seen myself. An online article around this document release, written tabloid style, that was changed in the short period of time between my first and second views. Was going to comment on it here because, depressingly, it wasn’t from the DM/Sun etc. – it was BBC News. Still contains a questionable bit of revised history, same byline, but a little more news vs. tabloid style.
The eye-opening part was, the original article said Charles gave H&M the money for them to set themselves up in their new life away from the RF. Not even a “BP says” and “while Harry has said” to indicate a minimal amount of research. Just a sentence, stated as a fact. Assume I wasn’t the only one who saw this, hence it was changed, but the fact it was even put out there in the first place, is just another sad note about the declining quality of news sources.
They report a lot of media narratives as established fact after they have laundered it through four or five different newspapers and morning shows. And yes, I realized a long time ago that all of these stalwart news organizations are just as bad as the tabloids at times.
Regarding this specific lie though, it seems to be pathological at this point to acknowledge that Harry was able to succeed on his own without being carried by his family. I don’t know if that’s because they still are operating under their impressions of his intelligence, or if they realize that he is the most accomplished and are trying to get some reflected glory back on to the family by making it seem like they are the reason for his success.
BBC/BBC News was controlled by then Tory government, which has always been in bed with BRF. If you expect seeing a somewhat more truth telling on British TV, Channel 4 is a better choice.
I’m in the US, where we certainly have our own share of decline in formerly reliable news sources. I’ve seen people here refer to the fact that the BBC is also not what it once was. Something from the BBC is one of the few things I’ll click on though if I’m just checking to see what the current online headlines are about H&M. And it wasn’t just the questionable information, but the tabloid-like tone of the original article that was a surprise.
I’m trying to figure out what the Trump regime’s strategy was here. They only follow the law when it suits them. Clearly, they wanted this stunt by getting the judge to agree to release the heavily redacted documents which didn’t even include Harry’s visa application. It’s almost like they were trying to humiliate the HF. If this really is the end of it, I’m glad Harry is not going to be subjected to the harassment and possible detention that so many others are experiencing. Not to mention being trafficked to a notorious prison-concentration camp in El Salvador. That story involving Venezuelan migrants is particularly horrific as are the photos and videos. There is no evidence any of them are criminals.

Trump probably doesn’t want questions asked about Melania’s visa, her parents’ visas, or Musks’ public statements about how he arrived on a student visa but never attended class but instead immediately started a business. I said the other day that Harry’s immigration application was never going to be part of the documents to be disclosed. It was misleading reports that suggested otherwise. From the court docs, the Trump appointed judge looked at the application & how it was processed & found there was nothing to suggest illegality or that Harry had received special treatment which is what the heritage foundation was claiming. There are no grounds NOR public interest arguments that outweighs Harry’s right to privacy. So all that was ever going to be released per the court ruling was the judges & govt dept justifications of their handling

A US immigration lawyer has said today in the times that disclosing the application without Harry’s consent would be a federal crime. And he also notes it would set a bad precedent for people like a Musk or Melania
Callers on the Jeremy Vine show are getting cooked for this non trovery stating the visa is a private matter. Also the court ruled Heritage Foundation failed to prove public interest (there is none) and failed to prove misconduct by government officials for Harry to get special treatment to get the visa. The HF claim they will appeal is a pathetic attempt to save face. I don’t think these clowns will follow through because they will have to come back with evidence that Trump DHS officials circumvented the process or flat out broke US immigration law to let Harry in. And HF would have to name names to the court.
They will not appeal. Appellate courts do not look at evidence but rather, they focus on legal errors and not on factual disputes. From united state courts .gov: “You cannot appeal a [court ruling] simply because you disagree with the outcome; you must have specific legal grounds for the appeal, such as a violation of your rights or an error of law”. Niles Gardiner will not appeal this ruling, just watch.
