Lindsay Lohan transferred to the same judge who told her to stop partying

As I was looking through our older photos of Lindsay Lohan sitting in court or on her way to court, I felt a really gross wave of nostalgia. Memories… like the crackies of my mind…. Misty water-colored memories… Of the way we were. So, Lindsay is due back in court for the pretrial hearing on the 30th, which is next Wednesday. I’m not looking forward to it at all. I’m tempted to not even cover the situation in real time and just leave an Open Post for all of you to enjoy the latest twists and turns of Lindsay’s cracktastrophe. You’re going to need to prepare yourselves for some stuff. Here, I made you a list:

*Lindsay really is supposed to show up in person. The judge ordered it specifically, and I guess she’s supposed to listen to the pre-trial motions from her defense. The actual court date for the big trial is February 27. Three days after the Oscars!

*Expect for Lindsay’s lawyer situation to be a hot mess. She’s got her NY lawyer Mark Heller and he’s hired two California lawyers to act on his behalf (because he can’t practice in CA).

*Prepare for Lindsay to go braless to court. She always does.

*Prepare for it to be a crackie fashion show. She loves the attention, and she loves showing off her designer clothes for the courthouse paparazzi.

*The LA court case involves her PCH car crash last June. She has been charged with THREE misdemeanor counts: willfully obstructing the accident probe, reckless driving and providing fale information/lying to a police officer.

*Lindsay’s case was transferred to Judge Stephanie Sautner. If that name sounds familiar, it’s because Lindsay has already been in front of Sautner before – she was the presiding judge on Lindsay’s jewelry heist case, in which Lindsay entered a plea deal and mandatory probation (which she is now in violation of). Sautner was also the judge who told Lindsay, “The only thing you have to do is follow all laws… Live your life in a more mature way, stop the nightclubbing and focus on your work, OK? I don’t expect to see you again. You know what you have to do.”

And lastly, in other Cracken news, Snooki has just revealed that Lindsay and Pauly D once hooked up. Snooki said: “It was the first time in LA and I feel like she was flirting with Pauly – and I feel like they made out… It was, like, three years ago… Personally, I like Lindsay. I think she’s a fun girl and she’s made a few mistakes and people thinks she’s the devil for it. [I met her in a club in 2012 and] She pulled me up to her VIP and she introduced me to her mother. I guess she clubs with her mother. Her mom is wicked cool. I mean, she was wicked cool. I was dancing with both of them. We were having a good time… they had a lot of respect for us. They like our show.” And that, ladies and gentlemen, is the story of Lindsay Lohan in a nutshell.

    Can someone explain why her case was transferred to a new judge (not new to her)? And didn’t Saunter say that if Lindsay violated probation she would lock Lindsay away for the remainder of her probation time?

      Lol maybe Saunter requested the case to really put her in her place. I’m glad and now I have some hope for actual justice. Lets see if the judge keeps her word.

        I hope so, but I’m not going to hold my breath… LiLo somehow manages to dodge every bad situation she’s in. I HOPE Sautner has a bone to pick with her, and actually forces her to face some consequences.

        She has dodged in the past because of an excellent lawyer, something she no longer has. From everything I’ve read, the new lawyer is NYC brash and obnoxious. I don’t see that type of thing going down well with Judge Sautner, especially given the fact that she has dealt with the Cracken before.

        If I remember correctly, which maybe I don’t, but I do NOT think Sautner particularly likes giving people jail time. So . . . if somebody got LL transferred back to Sautner and that’s true . . .

      Last I recall Lindsay was going to be in front of a judge that was a big supporter of rehab & not jail time? Suddenly yesterday it’s announced she is again in front of Hon. Saunter. I am very glad to hear of this change, but I have yet to read an explanation.

        The previous judge (commissioner) does arraignments and drug court specifically. Since the arraignment has already taken place, it goes to a judge who handles criminal trials that are not drug court, in this case Sautner.

        Lori, I posted elsewhere before I saw what you wrote, but I think I too remember hearing about a Judge who didn’t like giving people jail time. I think it was Sautner.

      Usually similar cases are consolidated under the judge that previously held it. I think this is for expediency – certainly cuts down on all that reading since the Judge knows everything about the case already.

      Like if several employees from different locations of a company files a discrimination suit, those cases will be rerouted to the Judge who drew the original case.

        @holly hobby – Thanks. That makes sense to me but you know sometimes with the judicial system the things that make the most sense never happen. It really should have gone in front of Sautner to begin with in IMO.

      The judge here saunter is a tuff judge she was a NYC police Det for many years in the 80s she worked out of the 34th pct in Washington heights and although it’s a good neighbood now it was not in the 80s my uncle used to work with her time to time and she was a tuff cop at the time hope this helps you with the case

    I always have my doubts when it comes to Lindsey facing any punishment because it seems like she can pretty much violate probation and they go.

    “Probation. What probation? Well we didn’t ‘specifically’ tell her she couldn’t drink so it’s okay”

    Like didn’t she violate probation with that judge and nothing happened?

      Actually, if given the choice I’d rather hang out with Snooki! Yeah, she might get drunk and puke in my shoes but at least she won’t steal everything I own, snort coke off of my coffee table and then get Terry Richardson over to take some gross photos. 😛

      Snooki is much much much better than Lindsay. Snooki paid attention the first time she appeared in front of a judge, acted respectfully to the court, freely admitted in court and in public that she messed up, did her sentence without fuss, and did clean up her act to prevent a repeat. She has family that read her the riot act, too, no excuses. I think Snooki will be fine. She didn’t go on to become a chronic problem for the court, which is exactly what judges hope for when they give chances to first time offenders.

      Chronic scofflaw Lindsay, though, is going to be toast if she has to appear before Sautner again. Sautner gave her every possible chance to get done with probation in a timely manner. I think the chances basket is empty.

        Didn’t the judge in Snooki’s case make some remark about how she should not emulate people like Lindsay Lohan and Lindsay got pissed and wanted an apology? I vaguely remember something like that. I don’t think Snooki is the sharpest tool in the shed, but I think she has at least matured since her son was born.

      This is the same judge Crackie had when she violated the terms of her last court appearance by not working at the women’s shelter. This judge, instead of reprimanding her, wrote out a schedule for Crackie to follow to complete her obligations. You or I would have been in jail. This chick is going to OD before she sees real jail time.

        I was thinking the exact same thing – this judge is a light weight. Wasn’t she also the one who said Lindsay didn’t have a drug problem? So there you go. I’d be truly surprised if this judge actually punished Lindsay.

        Exactly. Wasn’t it something like, oh, the Crackie just needs a schedule written out for her, poor child? My only hope is that this judge gets pissed because she fell for the lies the first few times and doesn’t want to look like a fool again.

        The problem is the sheriff, who won’t keep celebs tied down for more than a few hours and even non-celebs are being scooted out the door now since the county jail has to be used to house state prisoners due to overcrowding. Sautner would have loved to toss the little scofflaw into jail, but she knew she would be out the next day. So Sautner did the next best thing: forced the twit to complete her 480 hours of community service at the morgue (twit had only done 21 hours on her own by the half year mark). Sautner also refused to count the “homework” she had wrangled from the Red Cross when she was fired from CS at the women’s center. Sautner had to treat Lindsay like a five year old, but she did force the CS issue successfully. I think Sautner did the best job possible under the weird circumstances in that jurisdiction. Wasn’t she also the one who seriously tightened up the house arrest conditions once she received the reports about partying etc.? That suggests that if Sautner orders house arrest or rehab instead of jail, she will put real restrictions on the lass.

        I so hope that will happen, jwoolman. But because this is Lindsay Lohan we’re talking about, I’m not going to count my chickens until the little snatch is actually thrown in jail :D. The thing that ticks me off the most about Lindsay is that she had so much potential and SO many opportunities. She could have been a somewhat respected actress, could have made millions, etc. But instead she threw it all away to drug herself up and party, and doesn’t even seem to have enough self-awareness to realize what she threw away. I wish I had even a spinkling of the opportunities she had when she started out. But that’s how life goes I guess. I’m just glad I don’t have to prostitute myself out to keep myself in the lifestyle I’ve become accustomed too a la the Cracken.

        Actually this time MAY be different, like we all hope.
        Jail is usually reserved for lighter crimes and shorter sentences, typically less than a year. The Cracken is looking potentially at 19 months for the violated probation plus at least some 270 additional days for all 3 counts of the newest charges. That would take her out of the County Jail system (and the stupid LA sheriff’s celebrity ass kissing policies). With such sentence she would become the responsibility of the CA Dept. of Corrections and Rehabilitation. She would be housed in a STATE PRISON, which is not a good place to be, especially compared with LA county jail.

        Even though there is overpopulation in that system as well, she would be potentially looking at some serious time in the lockup before accelerated release.

        I mean, that’s what the law in CA dictates. Whether it will be implemented is a different story, but I do have high hopes this time around. Cracken is sooo F-ing dumb by choosing the jury trial. She will cost the state a ton of money for this insignificant, shitty litle case, and if found guilty may not only be sentence to prison time but also ordered to cover the court costs. And if unable to do so, she may be given extra time in lieu of un-collectable fees.
        All told, she may end up with up to 3 years behind bars, in a state prison, and maybe that will be FINALLY and TRULY the last we’ll ever hear from her.
        Good riddance to this gross dirty hooker. Try carrying on in your Malignant Narcissist ways in prison, ya dumb bitch, and see how quickly it gets beaten out of ya!

      Because the hearing on 01/30 is for a Probation Violation from a prior case. Any normal person would already be in jail awaiting the violation hearing or have a bench warrant issued to get them there. Technically at that hearing she may actually be sentenced to prison time, as direct result of her violating the terms of the probation. That’s why she HAS TO BE THERE – becase of potential sentencing.

      The hearing on 02/27 is the start of the new case, with charges of lying to police, and if it please the providence, she may actually be attending it on a prisoner transport bus, in nice orange jumpsuit, while serving the remainder of the revoked probation.

      Geez, I get all warm and fuzzy just thinking about it. CAN’T stand this selfish, delusional waste of air anymore.

    Well, why not go back to that judge? She went light on Lindsay . . .like they all do. They talk a good game, but let a ticking time bomb go unpunished. You just know it’s only a matter of time before she seriously injures or kills someone.

    If I ever had any sympathy for this beyotch, I totally lost it. I was always anti-drunk driving, but several years ago, my 16-year-old cousin was taking an evening walk with family members when a drunk driver ran off the street onto the sidewalk and killed him instantly (right in front of his father and brothers, my uncle and cousins). The guy was totally unrepentent about it, too. I could see Lohan doing something like that, and of course it would be someone else’s fault.

    I hate these judges for not making her pay for something, *anything*, that she has done. The law is an ass, indeed, at least in CA.

    Oh, and big shock that Snooki liked partying with Lindsay and Dina. Not to be a geographical snob, but they are on the same type of Jersey/Long Island-trash wavelength. I went to school in MD where a bunch of Long Islanders came (because they always paid full tuition, they were courted). Total Lohan-type garbage.

      So sorry for your loss. I lost someone to a drunk driver, too. Watching the woman chat and giggle on her cell phone outside the courthouse as though she hadn’t a care in the world…well, let’s just say that had I acted on my impulse, I’d be doing more time than she eventually got.

      As for Lindsey, just about every time I conclude that I have zero sympathy for her, something tugs at my heart and makes me feel just the tiniest bit sad for her. But know what? That hasn’t happened in a very long time. She has become something so loathsome and foul. Because she’s a human being, and for the sake of anyone she might hurt with her cracknanigans, I suppose I hope against hope she gets it together someday.

      If you’re going to take a ‘vacation day’, make it Feb. 27, this hearing on the 30th is merely pretrial and probably sorting out the representation issues. The REAL fun will be the actual VOP and new charges. Although I doubt she’ll actually take the ‘new charges’ to trial and will plead out, the VOP is where the action will be and that is on 2-27. Good times . . .

    She has never been held accountable so there is no reason for her to believe her state of grace will ever change. It would certainly make a lot of people jump for joy if the court said YOU LIE, YOU STEAL, YOU DESTROY, YOU DENY.

    Seeing the “cool” mother on Dr Phil was actually helpful. She’s so shifty it’s like there is no real person there. In order to be relatively adult you need to be at least a little bit consistent and accept some responsibilities. Neither one can do either!

      Maybe not … some judges go down hard on people who habitually waste the court’s time, especially when they have a bad reputation, as the new lawyer does. We may hear something like: “the two of you are authors of your own misfortune – LL, you had a lawyer who knew the case and you dismissed her, knowing that this date was coming up. And counsel, why on earth did you accept a case with a set date if you did not think that you could be ready for it”. That being said, it really all depends on how badly this judge wants this circus – and I don’t believe for a second that this judge cherry is allowed to cherry pick her case load – that’s very biased.

    Gosh she looked so pretty in that blue jacket photo with her hair up. *sigh* She used to look sort of normal, you know? And actually date instead of hook. What a difference 3 years have made. It will be interesting to see what goes down in front of this judge. I hear that the first time around they prefer to err on the side of leniency, but Lindsey now has a clear history of being dangerous to the public and herself, with her out of control behavior and documented shenanigans in rehab.

    I won’t believe anything I read or about Lindsey getting justice (e.g., like “sources” giving TMZ-style “exclusives” that she’s going to jail for x months, blah, blah, blah) until I actually see cuffs on her hands, an orange suit on her behind, and a sheriff that says yes, she’s behind bars for x number of MONTHS, AND that actually ends up being true. Until then, it’s all talk and talk is cheap.

    I don’t think she’ll get any jail time. She’ll probably get some probation with random drug testing and some time doing community service. That’s all I expect, they will not put her in jail for any amount of time, not here in LA, they are seriously overcrowded and she is not a violent felon, although some of you might disagree with that. The sad part is that it would help her if she got jail time and was able to get clean and sober and at least be able to think clearly without the use of drugs and also she would be without all her enablers and that might save her in the end, to get her to see just where her best thinking got her. But, that’s wishful thinking on my part, some people just don’t ever “get it” and I know some of those people, or I used to know them, they are not with us anymore.

      I think you’re right. I think all of this is/will be more of the same until she dies, probably when her body gives out. Which might be a while, given her genes, but oh well.

      Here in Canada it used to be 2 years got you a prison sentence as opposed to jail. 2 years less a day keeps you out. Do you have the same in the States? With her 245 days, plus 19 months for the accident and (dreaming here) 6 months for contempt of court isn’t that enough to send her to prison? Contempt of court alone should have her in prison.

        I’m pretty sure here in Jersey it’s 364 & under is jail, 365 & over is prison. Not sure about CA, though.

        I explained that deeper /a little ways up, @9.
        In CA jail time is usually reserved for lighter crimes and sentences under 1 year. Any sentence over 1 year gives you prison, and you are put under the CA Dept. of Corrections and Rehabilitation jurisdiction (as opposed to a County Sheriff’s for jail time).
        But the thing is that both CA prisons and jails are overcrowded. Sometimes they even transfer prisoners betwen one and the other because of overpopulation fluctuations.

    No judge is going to put a female celeb in jail in anything but a cursory manner, like Hilton was.
