Kelly Rutherford declares bankruptcy after epic international custody battle


Gossip Girl star Kelly Rutherford is currently embroiled in a bizarre custody battle with her ex, German businessman Daniel Giersch. Rutherford and Giersch share 50/50 custody of their two children: son Hermes, 6, and daughter Helena, 4. However a judge ruled that the children can live with their father in Monaco, since his Visa to the US was revoked. (Which may have been due to allegations Kelly made against him.) So Kelly has to travel to Monaco to see her children, although they do live with her in New York during the summer.

The last time we reported on Kelly, in April, she claimed she was broke due to the custody battle and said she’d spent “every penny from Gossip Girl, my pension, my stocks… fighting for my children.” At that time she didn’t even have her own apartment and was living with a friend. Now she’s declared Chapter 7 bankruptcy:

Kelly Rutherford is broke and she’s filed for full-blown bankruptcy, and it looks like her mega-fight over child custody was her Achilles’ heel.

Rutherford claims in her legal docs — filed with the court and obtained by TMZ — assets totaling $23,937 — dwarfed by debts totaling $2,021,832.

Kelly’s current monthly income is $1,279.33 … way down from her final season on “Gossip Girl” — $486,000. The show recently wrapped.

Here’s the problem — she spent nearly $1.5 mil on legal fees for her bitter divorce/custody war with ex-hubby Daniel Giersch. We’ve learned she’s asking the family law judge to make him pay, but now she’s waving the white flag by filing for Chapter 7 bankruptcy.

Kelly’s also in the hole for income taxes — more than $350,000 for 2012. Add to that another $25,251 for Amex charges.

Kelly has a total of $11,487 in her checking account, around 5 grand in furniture, 5 grand in clothes and $1,500 in jewelry.

According to docs, she’s borrowed 10’s of thousands of dollars from friends and relatives to dig out of the hole.

The bankruptcy petition was filed last month.

A lot of people think Kelly brought this on herself by trying to smear her ex, getting his Visa revoked, and working to alienate the children from him. Others think that she’s a victim of a vindictive judge who made an example of her because she’s rich (or at least she was rich) and famous. Whatever happened, it’s sad for their kids. It also goes to show how outrageously expensive lawyers can be.

        But,she did NOT do right by hubby (er rather ex- hubby ) #1.

        She left her first husband after about 3 months of marriage. He was only in his mid 30s. He had a sudden heart attack in the shower and was hospitalized and severely debilitated.

        She left home while he was still in the hospital and he moved back in with his parents caring for him. He died about 3 years later.

        He had some sort of heart defect that went undetected into his 30’s.

        I know one can never know what happens in a marriage. But can you imagine just getting married then being debilitated so young and your spouse is outta there???

      +1 it must be confusing to be back and forth across an ocean, with different languages, etc. That photo of her holding her son stopped me for a moment–thought that was her arm holding the cigarette, while also holding her kid.

      I bet she’s has a ton of cash in off shore accounts, rich people always get away with this crap. I think if we regular folk have to pay for the bankruptcy of the rich and famous they should be sent to debtors prison or forced to do community service. Same with those Real Housewives who get huge debts and then default on them.

    This story has been so strange. Shady sh!t on both sides.

    Also – I’m always stunned by the financial situation of some of these celebs. I get that Kelly racked up debt with legal fees – but it would seem that she should have more money than $11,000?? Right?? Maybe there should be those kind of financial coaches for actors like they have for NBA players now. Like, “Don’t spend all your money, save for the future, you may be out of a job soon” sort of thing…

      I have a friend that is forever thinking that what someone drives or wears is a determination of wealth. NOPE. I think we just get fog vision about what celebs have. Most of them are like athletes. When you are not at that top of the game you are not making the money people think you are. IN her case when that show ended so did her money. And it is all about investments and outlay. Which is why we see so many celebrities on DAncing w/the stars and other such shows. They are not as wealthy as we are led to believe.

        I agree. Lots of commenters below think otherwise, but I think that in being suspicious, they’re actually being naive. The lifestyle these people feel they need to live to boost their image is many times not commensurate with their earnings. And being an actor, even on a hit show, is one of the least stable professions. You can get cancelled or fired at any time and no show goes on forever. These poor kids. I have two friends who want to leave their husbands simply because they are bored and think they are too hot at 40 to waste it on them. They have no idea what they’re signing up for, for no good reason.

      TG – I was thinking the same thing. Because $500k per month for a few months each year over 6 years is a chunk of money.

      I know that you have to pay PR people and your agent. I know there are taxes.

      But to have roughly $20k left after earning roughly maybe $9million over 6 years????

      Hope she can hit on another job and soon. Really cute kids.

      Wasn’t that part of the reason she lost the kids (other than the crazy that went on)? The judge stated that she had the funds to be able to fly back and forth to visit the kids but the ex didn’t? It really looks dodgy. I mean, she has worked constantly and had been on profitable shows so you would think she made bank.

      But then, maybe she did blow through it all due to lifestyle and keeping up with the Jones (not to mention the divorce). I mean does a woman who is budget aware and living within her means really name her kid after a high end luxury fashion line like Hermes?

        I dunno, maybe she’s sold those things along the way. One Christmas, my husband sold a very loved, very expensive rifle to buy Christmas gifts for or children. There’s alot I would sell to fight for my children. But I don’t know anything about this sad case, so who knows what’s going on with her. Sad for the babies though.

    Also, I have no problem with people discharging their private debt through bankruptcy, but wtf is up with getting out of paying your taxes? This person listed $300,000 in taxes that she owes and “can’t pay”.

    Well, yeah, if I had spent all my money on other things that I felt like spending my money on instead of setting some aside every month to pay my taxes at the end of the year, I would owe money to Uncle Sam as well. That’s what taxes are – money that you would rather spend on other things, but that you have to give to the government instead.

    Maybe she could sell off some of that designer clothing and fancy jewelry to help cover her costs.

    Pay your taxes! It’s not optional.

      You can’t file bankruptcy on taxes. She probably had to list all her debts, which is why the tax bill is included in the report.

      Your taxes, and student loans for that matter, aren’t erased when you file for bankruptcy. The pecking order for creditors is: Uncle Sam and everyone else you owe money to. She is liable for those taxes.

      In Australia your employer automatically takes tax out of your pay every pay check and gives it to the government so you never see it. Then at the end of the year, if youve overpaid, you get some back. America should do this, non? I cant imagine having to pay a bunch of money on my own… it would be so depressing… way better to never see it!

        I’m Australian and can’t imagine having to budget to pay govt taxes (on top of everything else you pay for along the way).

        To the US Celebitchies how does this work in real life..do you have to pay it once/year or monthly? Do a lot of people find they don’t have the money?

        In the US there are two different types of employment – A W-2 Employee and a 1099 Employee. A W-2 Employee is usually a full time worker for one company who would have all taxes taken automatically from their paychecks and files taxes once a year.

        A 1099 Employee is usually a contractor or self-employed. This includes freelancers, actors, trades people, etc. (Including me) We get paid all of our money and then submit tax payments 4 times/year based on the estimated amount we’ll owe. It’s a guesstimate, really, so some years at tax time you owe and some years they owe you.

        As an actor, she would receive all of her funds directly (or sometimes the payments go first to her agent, who then pay her less their management fee). She would then be responsible for sending in her quarterly state & federal taxes as well as filing on April 15.

        Does that make sense? It’s, of course, way more complicated that it needs to be…

      If he is German, his children are automatically dual german citizens. The rules are different for EU citizens wanting to live in Monaco. It is not officially EU but has many of the same rules.

    Well of course custody is going to be awarded to the parent who isn’t couch surfing. If you throw all your money away trying to get custody, there’s none left to actually look after the kids.

    From what I’ve read it’s 50/50 shared custody anyway, and her ex has to pay for her plane tickets and accommodation in France. The whole thing just seems ridiculous.

      I know too many innocent and good people who have had bad things happen to them to believe in karma. Not saying Kelly or her ex fall into that category. Both bear responsibility for the situation, imo. But her kids didn’t do anything to deserve their misfortune. People like them are why I can’t buy into the idea of karma.

        I agree I don’t believe in karma either but I do believe in treating people who you would want to be treated. Though I tend to be more sympathetic to celebs and others who have not been nasty to others when something bad happens to them. But as I stated earlier I don’t believe she is broke I think it is a ploy to get her kids in the US and is a rich petson’s way to not pay her debt.

    This is defense of lawyers. My husband is a lawyer. He has a small practice with another attorney. Both of them handle divorce. A lot of people, who want a divorce go to these big fancy and expensive divorce firms, where they are fooled into thinking they are getting better results. But they don’t, the small firm guys, who charge half the price, can get the same results. They don’t charge you for all the bells and whistles. Also, Court filing fees have gotten very expensive.

      This. Also, the more she fights, the more the attorneys have to do, and the higher the fees. I’m sure KR was fighting tooth and nail over every single thing in the divorce, which pushes up the billable hours.

      Yes and no. Definitely for “regular” people. If your divorce involves complicated asset division, tax issues, protracted custody issues, God knows what else, you’re dealing with a savvy business person who likely has a cadre of high-priced lawyers at his disposal – – if you have a few-person firm, part of the big firm’s strategy will be to bury the firm in paper. Also, depending on the situation, sometimes a lot is in the relationships and power position the particular attorneys have. I think it’s an individual thing, but yes, the average person certainly doesn’t need to spend a gazillion dollars or hire some white shoe firm for a “regular” divorce.

      Also, I call major BS on that accounting of her assets. She’s probably wearing more than $5k worth of clothing in the header picture alone.

        It most definitely depends upon the case. Mom is a Family Law paralegal, and she helped me out with my divorce. My ex was a colossal pain in my ass, and it took THREE YEARS to get him to sign the divorce papers, despite the fact that he impregnated his “jump-off piece” and had her moved in within the first few months of my leaving him!

        He kept saying he “lost” them, or never received them and stuff like that, until her parents had actually set and paid for a wedding date. Then he was all gung-ho about a sense of urgency.

        We had 2 kids, 0 assets, and I took the new car (with the payment) and all the credit card debt, my kids, and the cat.

        It was RIDICULOUS.

    I believe everything is her fault. She tried to get rid of Giersch since she was pregnant with #2, the guy learnt from his lawyer that his child was born, then she didn’t want Helena to carry his name… And she constantly dragged him to court each time she wasn’t happy with his educational decisions with Hermes. She could have saved a lot of money if she had been able to communicate with him and if she hadn’t had his visa revoked. As for the kids, they miss her but probably not too much since I think nannies were raising them in the first place anyway.

      Actions have consequences. I do believe that she tried to alienate those kids from their dad thinking her celebrity status and money would do the trick. You reap what you sow and I feel not a scintilla of sympathy for this woman. Horrid behavior.

      Interesting how little we’ve heard about the kids while they’ve been living in Monaco. Very low profile. Good for him.

    What I want to know is: Did she make the almost $500K after paying her managers/agents/pr people, or was that what she made before paying her team? If it’s before, she may not have had even $250K (which still isn’t bad).

    That aside, I still cannot feel any sympathy for her. It seems she was one of those divorce-related malicious mothers (it’s actually a syndrome) and it came back to bite her in the financial butt.

    IMO – I believe she thought she’d cut him out of the children’s lives, get sole custody, have him tossed out of the country and he’d have to pay her a lot of money in child support (his family is wealthy). Instead, she’s alone and broke while he has the kids full-time in Monaco.

    Things didn’t quite work out the way she’d planned.

        For some reason, I thought it was for the year when I read it. It probably was a month. She probably thought she WAS LVW!

        So that’s about $3M a year. Figure $1 million went to managers/pr/agents, the rest is subject to taxes (which she apparently did not pay) and she’s still got about $1M. Gossip Girl was on for 6 seasons, that’s $6M she had the possibility of making after expenses. She could have bought a nice apartment and lived very well for the rest of her life if she had not been so vindictive.

        Ultimately the kids are the ones who suffer, because their parents seem to hate one another.

        The Trustee, who will be responsible over the bankrupt estate is very good at digging out all hidden assets. Yes, if she doesn’t report all her assets and they find out, she can go straight to jail.

    I don’t think fighting the ex to the point of bankruptcy is really in the best interests of her children, especially since her ex seems like a decent enough parent. She seems to want full custody at any cost purely because she just cannot stand to share the children with a man she now despises. If her children are exposed to dangerous influences when they are with their father and that is the only way to remove them from that situation, I could understand. As is, I think she’s just inflicting unnecessary financial hardship on everyone involved. If she really is broke and not just faking broke for some advantage in her fight against her ex that is.

      That is what doesn’t make sense to me. Her two main projects have been Melrose Place and Gossip Girl. After all the costs of being in the industry: PR, agents, and lawyers, she probably doesn’t have much left. And people are pointing to her clothing and accessories, even minor celebrities get a crap ton of that stuff for free.

      I don’t think she was ever “super-rich” but I do think that anyone working as a regular on a TV show should have more than $11,000 in the bank. She was hardly making scale, you know. She was not a day player. She would’ve had contracts and would’ve known exactly how much would be left after her management was paid.

      My only comment is that a little forsight might have saved her some strife. Lord, I know regular working class people who fight for custody, don’t declare bankruptcy and certainly have never made $400,000 a year who can still afford to remodel their homes, send their kids to college, etc. The extremes of her financial situation speak to her drama (IMHO).

        He is the one claiming that the smears have led to the visa problems. However is he likely to admit that something he did actually caused this.

    This case just goes to show that people NEVER really do whats right for the kids. Like get along and compromise to avoid nasty battles and lose every financial stability for their children’s future. All that money could’ve been saved for their kids college.

    The kids were born in the U.S. It’s their father’s fault he lost his VISA. Kelly couldn’t snap her fingers and make it happen. He’s responsible for his actions that caused him to be denied entry to the U.S., whatever they are. The kids shouldn’t have been taken to live somewhere else because he did something to lose his VISA.

    Has he tried to fight the charges, or applied to get his VISA reinstated? Did he make any effort to live closer to the kids in N.Y., like Canada?

    He’s not a French citizen. If he wanted to be next to his family, he could have gone back to Germany. It seems to me like Monaco was probably chosen so he could continue to avoid paying taxes.

    The judge in this case apparently has a history of ruling against mothers. I don’t believe full custody children should automatically go to mothers, but in this case they were born in the U.S., they’re very young, and there were no findings of neglect or abuse. The judge should have let the kids stay in N.Y. and ordered Kelly to take them to visit their father on a regular basis, and let him have them for extended periods during the summer and holidays, with the understanding that the ruling could be reversed if either parent failed to live up to their end of the deal.

    This is why i am terrified of having kids with somebody/getting married. If it all turns to shit, the best case scenario is that you only have your kids half the time. The worst is that they are taken to another country and you only see them a few weeks a year. Very upsetting. If your partner is going to be 100% unreasonable then there isn’t much you can do, no matter how mature you try to be. Sad situation for all involved.

      You think you know a person. But divorce and moving on can bring out the worst in people. Kids get caught in the middle. And everybody loses

        Yeah, divorce makes people ugly. How sad to turn so drastically against somebody you once loved. With the frivolous way a lot of people treat marriages these days (divorcing after 2 years instead of trying to work through problems) it’s really not that appealing to me.

    I feel sorry for her that she is in this mess but it’s mostly her fault. You can’t go around doing the things she did against her husband and not be punished for it. This is just karma. She could have avoided most of these problems by just being nice to him.

    As for the bankruptcy, she had to list all of her debts, including the tax bill. The tax bill will not be discharged in the bankruptcy and she will eventually have to pay it all or go to jail. (Maybe make a deal with the IRS.) Also, interest is accured monthly on the taxes while they are waiting to be paid. She is also not “hiding” money as some have suggested because that would be illegal and very, very stupid. The courts in America do not play like that. There are people whose only job is to check out bankruptcy filings to make sure there is no hidden money.

    Also, people should remember that “Gossip Girl” was not on a major network so she didn’t make the really big bucks over a long period of time like the actors in “Modern Family” for instance. She probably started out at a pretty low rate (maybe $10k-20k/per) and worked her way up. After paying off all the lackeys that surround actors, plus the daily living cost in NY, there really isn’t that much left. She did say she has used up her pension and stocks. So I think this bankruptcy is legit.

    Out of fairness to the expensive lawyers, this custody battle began while she was still pregnant with Helena (4-5 years ago), and has taken on international contours which require a whole other level of specializiation. $1.5 divided by 5 years, and likely split between a divorce lawyer, a child custody specialist, and an international lawyer.

    Unless there is something legally defective about one partner (ie. mental incompetence, or incarceration) the majority of jurisidictions in the US encourage shared custody between parents. The NY courts have a strong presumption to share, and the cost of providing evidence and fighting that presumption falls on the parent who wants sole custody. (Again, in the court’s eyes it requires more than ‘my ex is a jerk who doesn’t pay taxes’ – there must be a legally recognized reason the dad can’t have access to his kids – this works both ways- usually when there is an obvious reason it’s also a legal reason – ie homelessness, mental illness, or incarceration)

    The Judge was not being “vindictive” – the judge is paid to sit there and weigh both sides of the argument and try to provide a fair solution that takes both parents into account, while keeping the best children’s interests first. Kelly was being vindictive. She would’ve been better off spending that money on therapy and trying to find a co-parent solution. She escalated this conflict, and acted in very selfish and immature ways. Frankly, both parents were behaving unreasonably. I’m sure the judge lectured them both many many times about putting their children’s interests first. However, its her ex that was left without the ability to legally stay in NYC with his kids… What would you have done?

    I must be missing a major piece in this puzzle here. Has he said she is a bad mother or something? Does he have proof? And if not then why and how did he get custody? My understanding about the custody laws here in the States is you could be a total barfly and still retain custody and Rutherford is no barfly.

    I feel sorry for the kids. And from what I’ve read it does sound like she and the children were penalized by a vindictive and irrational judge. The lawyer appointed independently appointed by the court to look after the best interests of the children, said it was best for the children to stay in New York where they had spent their entire lives. Not to mention that their father isn’t French and apparently isn’t a French citizen either. Neither are his children. The kids are American citizens, so I’m really wondering how it was legal to send them from a stable home in a country they were born in with citizenship and legal access to every right and privilege a citizen has, to a country that neither they nor their parents has a home or a permanent citizenship. The judge sounds insane.

    It’s 50-50 custody. I can’t for the life of me figure out why that is worth fighting over. Regardless of their home base, she’s only seeing them half the time. So she travels there instead of the other way around, so what?

    What she wants is the father out of their lives, and thought she could steamroll the court system into giving her her way. Didn’t happen and she’s learned a very expensive lesson.

    I don’t feel sorry for Kelly I think she did have something to do with her ex being throw out of the country I think the judge was being fair to both of them in beginning for the custody battle. I think that Kelly actions during the custody battle show her true color she didn’t let the father of child know his child was being born she refused to let him sign the birth certified she flip out because her ex potty train their child . Kelly refused to co parent with her ex and try to shove him out their kids life and that why the judge made the ruling she did . Just because Kelly a mother doesn’t automatically give her more rights to their children than their father .To me Kelly is just like Halle berry and Bethany once they were done with men in their lives they kick them to the curb and went all balls to wall crazy on them and try to actively get them out of their children live forever and that to me is evil .

    There’s a lot at play here that some people don’t know about: She played hard and fast with her claims about her husband, likely to paint him as an unfit parent (which backfired phenomenally when his VISA was revoked, due to her claims that he was an international drug runner and arms dealer); left him while still pregnant with their daughter; denied him access to her birth; and just generally all around did anything and everything she could to deny him access to the children.

    THAT’S why HE’S got custody of the kids in foreign country. Oh, and he was also ordered to pay her airfare to come see the children.

    Now, I’m not saying I agree with this particular judge’s decision, but I’ve also been told by FCS that they “recommend custody of minor children goes to the most ‘cooperative’ parent.” And when one is dealing with a sociopath, that is VERY disconcerting!

    At the time I wondered if being pregnant had made her temporarily crazy. But then she gave birth and the crazy continued. I am happy that these children are enjoying a stable life with their father. Some women behave as if having the womb gives them extra rights and privileges. It doesn’t and shouldn’t.

    This is exactly why you should always work as hard as you can to keep a good relationship with your ex, and try to work out an agreement amicably between yourselves, or, if necessary, with the help of a mediator. Lawyers getting involved hurts everyone. Obviously, sometimes no matter how hard you work at it, your ex might be impossible to deal with except in this way as they jump in with lawyers first, and of course I am not referring to abusive exes when I say this. But if you can manage it, you should always put aside your own hurt feelings and just do what is best for the kids. It will help your own bank balance and I think that in vindictive cases it doesn’t actually make people feel better afterwards. Just poorer and bitter.

    I’ve followed the case and I have to say that I believe that her ex and the children are the true victims. I dont know what really went on in that relationship that caused it to end but to me it always seem as if Kelly was more concern with appearing as the wronged one to justify being so difficult, stubborn, uncooperative, and extremely diffcult. Whatever negative feelings she had about their marriage she carried over into the custody batted and it didnt have to be that way. Assuming that both parents love and want the very best for their children I couldnt understand why she didnt agree to 50//50 custody arrangement. She even went as far as to get her ex banned from the delivery room for the birth of their second child. As far as we all know he has never been violent towards her or the kids or made threats on their lives. Its like she did everything within her power to make sure her ex played a very small fatherly role in their childrens live or no fatherly role at all. If that is true then that is fucked up. As long as both parent are loving and caring and truly wants whats best for the children first then their children need and deserve both parents in their lives. More times than not mothers are always awarded primary custody even if the father is just as good a father as his ex is a mother. For Kelly to lose full custody means she had to have done something awfully bad that pissed off the judge and it is documented. I cant remember if she was awarded 50/50 or primary custody but she had the upper hand and all she had to do was obey the judges order which was to allow him generous visitation. She didnt want to do that and even when she got in trouble for it she still continued to disobey the orders. On top of that she wouldnt put her ex’s name on the second childs brith certificate. If you really think about it it doesnt make since. Why put the fathers name on the birth certificate for the first child and not the second? Everyone knew who knocked her up. Thats just one example of her being extremely difficult for no good reason at all. Ultimately, I dont believe she lost her children because she is a victim. She lost them because of one of many vindictive and mean-spirited things she kept doing. Also I believe that she was behind his Visa problems. One little false tip about bad business dealings and the custody battle gets that much easier for her.
