Back in March, In Touch ran a cover story claiming that one of Kourtney Kardashian’s old lovers was questioning the paternity of her three year-old son, Mason. That wasn’t the first time we heard about that, though, Kourtney’s ex lover, Michael Girgenti aka “Premo Stallone,” demanded a paternity test for Mason back in January, 2010, when the boy was just a month old. Premo maintained that he’d slept with Kourtney when she was on a break from her boyfriend, Scott Disick, and that he could potentially be Mason’s father, not Scott. So Premo has consistently gone public with claims that he could be Mason’s father, and he’s now filed a paternity suit demanding a DNA test. He’s seeking joint custody if Mason is his son:
A male model who claims he had unprotected sex with Kourtney Kardashian in 2009 claims 3-year-old Mason is HIS son and he’s now filed a paternity lawsuit asking for joint custody … TMZ has learned.
Michael Girgenti claims in legal docs — filed Thursday and obtained by TMZ — he met Kourtney during a photo shoot in August, 2008 (above). Girgenti says they connected and began a texting relationship for 3 months.
Girgenti says in legal doc things heated up by March, 2009, when Kourtney allegedly told him she and then BF Scott Disick were “on the outs” and “she wanted to hang.”
Girgenti’s suit then describes an alleged sexual encounter in Glendale, where he says they had “unprotected vaginal sex.” He adds, “I ejaculated inside [Kourtney’s] vagina.”
Girgenti says 9 months later Kourtney gave birth to Mason. He says he immediately saw a striking resemblance and tried contacting her, to no avail, so he began a media blitz to get her attention.
Girgenti’s docs, filed in L.A. County Superior Court, request joint custody of Mason. He also wants the judge to order DNA tests for Kourtney, Scott, Mason and him. The judge set a hearing for next month.
We also know Girgenti received a letter from Kourtney’s lawyer, Shawn Holley, saying his allegations are “false and defamatory.”
BTW — one of his claims in the docs is that Kourtney’s second child, Penelope, doesn’t look at all like Mason. You be the judge.
The fact that Kourtney ignored this guy for so long doesn’t sway me either way. She’s famous and she can’t respond to claims like this like a regular person would. Now she may be court-ordered to submit to a DNA test for her son, though. What’s going to happen if Scott isn’t Mason’s dad and if Scott got cuckolded? I see Scott sticking by Courtney, but if she knew that he potentially wasn’t the father and she misled him that’s so cold. Maybe Scott knows already, though, it’s hard to tell what goes on in their relationship.
If it turns out that Premo is Mason’s dad, I see him famewhoring this as much as possible. He’s already gone to the tabloids several times. This could be a mess, and I just feel sorry for Mason and Penelope. The Kardashian family is having some serious problems lately.

It’s very possible. Both kids have a lot of Kardashian in them (eyes and coloring) so they can still look alike yet have different fathers.

I must be missing something here, because I see nothing “stupid” or “try hard” about his hair. Is there mountains of product in it or does it appear that Kourtney has spent a ton of time carefully styling it? Yes, I understand that he spoke up/wanted a paternity test three years ago, I said that in my first post. What I don’t understand is why he waited so long to file for the test. I also distrust that he is an aspiring rapper and this very well could be a publicity stunt for his work.
If it is actually his kid, then I feel bad for him for her having ignored his complaints for so long. Most likely she doesn’t want to face the possibility that this isn’t Scott’s kid. Apart from losing a bunch of time with the child, she will most likely have to pay child support as well.
I read the whole article while I was getting my toes done a few weeks ago and apparently the Greece episode of the Kardashians was Scott finding out about him possibly not being the father. That apparently he was out drinking and flirting with girls and not on the Ktrash family vacation because of the news, until later did he join them.
Personally I think Mason does look like the other guy while their youngest looks like Scott. Mason has his mom’s nose and looks more like his mother’s side than Scott. But all the while he does resemble the other guy in ways.

We are a mix of my dark haired but fair mother, and dark skin, blue eyed, light haired father. I married a man w fair skin, curly blonde hair, and blue eyes. Our girls all have his hair, skin and eyes, even though when you do the Punnett Square, my features should be dominant. Genetics is a crazy thing!

Scott was extremely wealthy before he met Kourtney. His family is one of the richest on Long Island from the Hamptons. He also has a few things he does on the side, but mostly it’s his families money.

You have to provide some evidence to the Court that there is a possibility that you could be the biological father- any old Joe can’t go to Court to demand a paternity test. It appears that he filed an affidavit which details the fact that he had unprotected sex with her, and likely includes evidence that verifies his claims (apparently it was filmed for the Kardashian show). Based on the evidence that he provides, a Court could order a paternity test and if he is the biological father, he could petition the Court for parenting time (and with that could come child support, possibly).
Yes, the court can order a paternity test IF this guy has enough proof that he might be the father. So it all depends on what proof he brings before the Court and what the Judge thinks.
However, even if the Judge does order the test, Kortney can drag this thing on FOREVER,or at least until little Mason is old enough to say for himself if he wants a DNA test or not.

Scott is Mason’s father. Yes, Mason favors the Kardashian clan but Mason’s chin with the subtle cleft and ears (especially the earlobes) are EXACTLY the same as Scott’s. Scott, Mason, and Penelope all have the same chin and ears. Just look at the pictures and study them. It’s not hard to see he (Scott) is the father.

One kid being darker doesnt mean anything. I have 2 older half sisters from my dads previous marriage long ended before he met our mother. My father is Native American & mother is a light skinned blue eyed blonde European (his ex wife light as well). Now our oldest half sister looked more like my lil sister of full blood growing up even thru high school photos (both are light skinned, hair, eyes). Til the day my other half sister passed away 10 yrs ago she coulda been my older twin we looked so much alike (darker hair, skin, & though green.. Dark eyes). They’re Armenian, and unlike Kim, she looks Armenian and not like a plastic Barbie with dark hair. I never suggested that she wasn’t Caucasian. I’m Caucasian but I still have my ethnic looks (Italian and Hungarian, but the Italian dominates).

Michael has been claiming paternity since day one. It seems to me that if this pisses off Kourtney as much as she says it does and is 100% positive Scott is the father like she says, then she would get the stupid paternity test to shut Michael up and end the constant speculation. This speculation does more harm to the Kardashians than benefits Michael – particularly in light of Kris’ indiscretions and the questions of Khloe’s paternity. She should take the test and put an end to it. If she is right, she has nothing to lose.
I don’t think it’s any big deal that the kids don’t look alike. I have a son a few monhs older than Mason and a daughter a few months older than Penelope. Both kids have the same father, but my son has dark coloring and my daughter has light coloring. Same as Kourtney’s kids. Genes do funny things.
I thought they settled that Scott is the bio dad a long time ago, although the story I remember is that a one-night drunken stand was indeed involved and that’s why Kourtney wasn’t sure. Is this that guy or a third one in the mix? Sounds like a longer relationship than a one-night stand. Anyway, I had the impression that testing was already done. I googled a little for older articles and I’m not the only one that thinks they had DNA testing done a long time ago. Of course, everything could have just been scripted for the show that way so it’s hard to tell what’s real with them. But I do remember Kourtney herself not being sure because she had sex with both Scott and some other guy within a short enough time period and supposedly she was relieved to verify it was Scott. I doubt that every woman “knows” who the father is under such circumstances, as someone else thought.
Hope this is just wishful thinking on the other guy’s part, Scott has been that kid’s father since before he was born. Hope the guy isn’t trying to mess up the kid just for the big custody child support payday, since her income is so much bigger than his. Do guys really get that attached to their wandering sperm when they don’t have a permanent relationship with the mom and especially just a one night stand? I know the law will go after them, but I’ve always thought that was really just to avoid having to pay government money for support. It’s never really seemed right to me, women should be ready to be single mothers in such situations rather than sic’ing some stranger on their kid as a dad. If Kourtney and Scott decided they are both the parents, with or without a paternity test, that really should be the end of it. Get a contract, guys, before you let your little swimmers near her eggs if you really want to be a dad.
He has his chin divot and eyes…I always thought he looked nothing like Scott. I would be better of he posted a picture of him when he was a baby….
DNA tests take 3-5 days for results so kourtney is milking this as much as the other guy. She could nip this one real fast herself. I agree she ant respond to everything but this is a whole different issue. She wants the publicity as much as the claimant
Mason certainly doesn’t have the big pelican beak that the model does. If the model doesn’t have some evidence like e-mails, etc. and I understand he has one, then the DNA test might be denied. I hope they don’t pay him off to make him disappear. I think that’s what he’s after, a settlement, bogus claim or not.
I think Mason looks a lot like Scott, but with Kourtney’s darker complexion.
Or is this another plot so the public wont forget about them? Wonder if this guy is going to magically go away the minute kim makes an appearance with her baby…? Anything seems to be possible for this family! No morals or scruples whatsoever…. Poor children who are born into that family.

As flawed as their family is its their family. One night stand dont make you a father you’re barely a sperm donnor. Does he calls his exesone night stand to see if they had any kids ??? No. No men do.
I feel for Kourtney because if he is the father she had to know, she didnt want him involve. And the truth is her to know, Scott’s and Mason. No one else.
Scott is the only father is has ever known. The model only wants money. Thats why he’s asking for joint custody.
