As everybody knows by now, Kim Kardashian dropped the receipts on Snapchat on Sunday night. Kim initially spilled the tea that Kanye West had recorded the conversation between himself and Taylor, wherein he asked for her permission-slash-gave her the heads up that he was going to put her name in one of his songs. Kim told that story to GQ, and she also told GQ that following Taylor’s I’m-the-victim Grammy speech, Swift and West had not spoken, but Kanye had heard from Taylor’s lawyer. Kim told GQ that Swift sent “maybe an attorney’s letter… saying, ‘Don’t ever let that footage come out of me saying that. Destroy it.’” Kim pointed out that the recording was part of the documentary footage Kanye was shooting around the making of his album, The Life of Pablo.
Kim also noted in that GQ interview, “When you shoot something, you don’t stop every two seconds and be like, ‘Oh wait, we’re shooting this for my documentary.’ You just film everything, and whatever makes the edit, then you see, then you send out releases. It’s like what we do for our show.” Which is true. That’s how a lot of these documentary-style things work. Do you think Beyonce is constantly getting releases from everyone around her as she’s being followed around by a videographer 24-7? No. She’s not. She gets releases from people as she uses certain footage in videos, concerts and more.
Still, the whole issue of “did Kanye inform Taylor that he was recording her and did Taylor give her permission – written or verbal – to be recorded and have that recording distributed on Snapchat?” is the question of the day. TMZ reports that Taylor and her lawyers threatened Kanye with “criminal prosecution” months ago for making the recording. It was likely recorded in Kanye’s studio in LA, and it’s against California law to record someone without their consent. It’s a felony, punishable by a fine and up to a year in jail. TMZ got their hands on the letter Taylor’s lawyers sent to Kanye, and wouldn’t you know? Kim was telling the truth about that too. The letter demanded that Kanye “immediately destroy all such recordings.” TMZ also reports that Taylor is weighing her next step carefully.
Taylor Swift is thinking about filing a crime report against Kanye West for illegally recording their phone conversation, and against Kim Kardashian for publicly releasing the audio … TMZ has learned. Sources familiar with the situation tell us Taylor is undecided and is trying to think through the consequences of filing a police report.
TMZ broke the story … when Taylor’s team found out about the recording, her lawyer fired off a letter to Kanye’s attorney, threatening legal action and notifying him the recording was a criminal violation … punishable as a felony.
We’re told Kanye made the recording in the L.A. area — and in California, a party to a phone conversation cannot record it unless all parties agree. Taylor had no idea she was being recorded.
Here’s my question… if Taylor had no idea she was being recorded, how did she and her lawyers know that there was a recording (an illegal recording) which needed to be destroyed? When was the letter sent, and when did Taylor find out that she had been recorded? Is there another Snapchat receipt just waiting to be released in which Kanye tells Taylor, “Oh, I should tell you that you’re being recorded as part of my making-of-Pablo documentary”? Kanye’s team told People Magazine that did happen, sort of. A source told People that “the rapper always records his entire album-creation process for his archives, and that Swift was made aware she was on tape. The source adds that Swift is on video approving all the verse lyrics, including ‘I made that bitch famous,’ which wasn’t mentioned in the clips released Sunday.” YES. That means that there are more Snapchat receipts to come!!!!!
While Taylor Swift has every right to pursue criminal and civil charges – and she might even have good cases for both civil and criminal litigation – I also think that the damage has already been done. Suing Kanye now would be like closing the barn door after the horse has bolted, PR-wise. These stories about Taylor possibly/maybe thinking about pressing charges or filing a lawsuit were a decent attempt by her PR team to deflect away from the primary conversation, which was that Taylor and her people misrepresented the conversation with Kanye and they lied about the substance of the conversation just so Miss Bad Blood could play the victim at Big Bad Kanye’s expense once again. What’s striking (to me) is that I’m really getting the feeling that there are additional recordings yet to come, and Kanye and Kim are waiting to see how Taylor plays it. If Taylor does sue, perhaps there will be another Snapchat where we get to hear Kanye tell Taylor that she’s being recorded and she gives her verbal permission.
Update: In a new story on TMZ, sources claim that Taylor could not press charges against Kanye for recording their conversation because it’s not against the law to record a conversation that “may be overheard.” As in, Kanye had Taylor on speaker in a room full of people, including Rick Rubin, and Taylor knew she was being overheard, and she was even talking to other people in the room.

I think Taylor wants to and if she could do it with out the public knowing she would. But Taylor knows this will not do herself any favours. She must be livid, it was all #taymerica and then this. Not sure if she was aware of been taped and it’s so hard to know with all these people but I would probably feel a little violated if someone recorded me with out my consent or my knowledge.

But if Taylor knew she was on speaker phone and knew other people were in the room at the time because she spoke to them as well, does that mean it wasn’t a private conversation? Whatever they said to each other was heard by other people anyway. I’m not a big fan of Mr. and Mrs. West, but it seems as if Kim may have checked into the legal consequences prior to leaking the receipt.

I think you are correct she was heard by all, as the interview I read a tiny part of Kim said Kanye records everything from his sessions and doesn’t stop when he calls someone the recording was still on and if on speaker phone she could hear. I also think they may be idiots but as litigious as people can be I bet they contacted some lawyer before releasing it
Of course Kim checked with her legal team before releasing the video on Sunday. This is the daughter of the lawyer that got OJ off. She made sure her ass was covered before she posted that video.
I’ve wondered if the the lack of Kanye reciting “I made that b!tch famous” line means she’s holding back that clip. That seems to be the lynch-pin of Taylor’s defense so it wouldn’t surprise me if she plans to post that part of the video next.

And Kim was still very young when he passed. It’s more likely he wasn’t instilling legal awareness on her vs parenting. By all accounts it was all parental. Checking with lawyers is just smart. Given her show, the years of being in the public eye I’m sure she and her teams are well aware to send everything through legal before it happens.

Wrong. The two-party state prevailed in Kearney vs Salomon Smith Barney and most judges err on the side of the state with the stronger laws – which is the two-party consent state.
But that is moot because it looks like Taylor knew there were other people in the room and had no reasonable expectation of privacy therefore she can’t – and won’t – sue.

I’m surprised that people are actually on the Kardashian’s/West’s side. Taylor made a big mistake by talking to Kanye and she also might be a mean girl, but what Kanye did was a really poor move. Her mistake was not answering his call but to repeatedly lie about it. She threw him under the bus very publicly knowing that her innocent girl next door image would make people believe her over Kanye who is often less than coherent.

It would take much more than a court deeming her acts illegal to destroy her.

But Diane has been travelling all over Europe with Reedus – they went to a fourth of July party in Tuscany together and were seen in Amsterdam and Paris. My gut feeling was that KK and Kanye are way too aware of their own interests to post the receipts without heavily vetting the matter with an attorney first. Say what you like about them, they are not morons. They absolutely have more recordings to post. As for Tay Tay, if she or her reps directly state that they will sue, that will speak volumes. So far everything seems to be coming from “unnamed sources.” I would think if she had a solid case, her lawyer would have filed charges by now, or at least made a statement.
I read that Taylor was in NY for the phone call and NY does allow recording without the other party being aware of it.
I used to watch KUWTK at one point (go on and judge me) and there was an episode where Kim says that she isn’t stupid, her dad was a lawyer (paraphrasing). I don’t think Taylor’s in on it. She is so obsessive about controlling her image, a very specific good-girl-victim image, there is just no way she comes out of this looking good. Maybe the real true blue loony fans still think she’s been misled and set up by nasty old Kimye, but to anyone else with a brain, she looks petty, manipulative, and dishonest. She was happy to be their victim but no way she would sign off on playing THIS role.
I don’t think so. I could see them agreeing to start a feud where both could play the victim in their different ways and that’s basically what’s been happening up til now. Taylor’s been doing her ‘why are people so mean to me’ thing, and Kanye’s been doing his ‘why is my genius so misunderstood’ thing. But this latest reveal does nothing for Taylor, it’s just a question of how damaging it is.
She doesn’t just look conniving, she looks unbelievably stupid for lying about something she had to know could be disproved. It’s hurts her ‘poor me’ image, an image she’s very carefully cultivated over the years, and it also hurts her ‘brilliant businesswoman’ image. If she was that good, that powerful, she’d have been able to shut this down. It hits her pretty much everywhere. There’s no upside for her other than the fact people are talking about her, but she doesn’t need to drag herself to get press, she was already getting a ton. It just doesn’t make sense that she’d be in on this.
I think all of this is fake-a-roo. The timing of how everything is unfolding just seems too planned. Or maybe I’m wrong and ALL of these people really are this immature.

I’m serious. She has long time fans on Twitter going on rants about how she betrayed them and they’re done with her. She has other celebrities liking posts about how she’s fake. She has multiple websites parsing every word she’s made about this whole thing and literally posting statements and videos right her right next to the evidence Kim posted.
I just don’t see how people always say, “They’re in on it” when stuff like this is media suicide. This is the stuff that makes PR agents have nightmares.
Initially, yes. But Taylor’s reputation as princessy victim was at stake. Unless she wants to self sabotage that image and create another one similar to Rih. A man-eating, baller b*tch. Her schtick is getting stale and you can only write a heartbreak diss song for so long. But I won’t be surprised if this is another publicity stunt.
I’d be inclined to side with that view were it not the enormous amount of damage that this has done to her reputation. Her brand of playing the victim that rises above the strife has been dismantled with this revelation of how deceptive and manipulative she is. She has absolutely nothing to gain from PR nightmare she’s brought on herself.
Journos and other celebrities have been hesitant to speak out against her because of the backlash they’d get from criticizing “America’s Sweetheart”. I think we’re starting to see just how unliked she has been among her peers and some of the press now that her true nature is being revealed.

If it is, I hope it is because she wants to change her narrative to a more mature, introspective and thoughtful artist. It would be a great opportunity to go away for awhile, come back with a folk-ish album with songs about the magical sights, sounds and smells of the Australian back country, romantic nights by the light of the moon and so on.

This is garnering a lot of publicity, and people are actually invested in it, digging deeper, figuring out timelines… And then it’s all part of a Kanye West semi-documentary, a contemporary comment on the ruthlessness pursuit of celebrities and the will to believe just about any romour being sent out about them.

I strongly disagree. He apologized for it and, as she states in the phone call, sent her flowers. It was also about *seven* years ago, and they both have acted as if it’s water under the bridge.
Meanwhile, Kanye called her about the lyrics for her approval, which she explicitly said was very kind of him and that he didn’t have to do that. Then she very publicly threw him under the bus for no reason at all.
I agree, Locke Lamora. I watched the whole show that year live, and it really wasn’t a big deal. It was definitely rude but it wasn’t the full blown attack people make it out to be. Plus, Taylor got her chance at the end of that show when Beyoncé gave her speech time. I remember at the time thinking that Taylor was kind of rude to Beyoncé and not being appreciative to her for sacrificing her speech time. Not to mention in the years since Taylor’s won so many more awards – hindsight, but it’s still odd that people characterize that moment as something so much more than it was.

@GNAT – I disagree that the VMA incident was as proportionally bad as this (or even what Taylor did at the Grammy’s). Like I said above, Kanye interrupting Swift was bad, but it was: spontaneous, not personal, clear he was going through personal issues with the death of his mom, AND HE WENT ON AN APOLOGY TOUR. Swift set out to personally make him look bad at the Grammy’s. She had a pre-planned narrative (that plays on racial optics, but that’s explained above). And we all know, Taylor had no intentions of ever apologizing. Furthermore, that VMA incident didn’t make Taylor famous, but it has made her “infamous.” That can’t even be argued. It’s a moment that has equally defined both of their careers.

This is a big white fragility moment in which the person constantly described as ‘harmless’ and ‘great role model’ got exposed as publicly conniving and destructive. It occured to me that Taylor is the Blake Lively of the music business (though to her credit with a lot more discernible? talent) she’s been skating hard as hell through life using her sweet Apple pie making blonde image against EVERY one.
Kanye can be gross but she took that phone call, she was happy as Skittles on that recording, saying “She didn’t know it was being recorded” while being in touch with ANY member of the Kardashian clan is delussionsal. Saying it was this particular phrase or that particular statement when she happily clomped onto the Grammy’s stage and said how she’d never let someone else take credit for her work and that she never even took that phone call in the first place was just amazing.
And the most amazing thing of all is…I honestly believe if she had just left it as is Kim and co. wouldn’t have released the video. I think as they realized she was going to ride this new victim train and “I’m a survivor” persona that it was better to sink her with the truth than let her paint them all as monsters. Better or worse Kanye told the truth, I know damn well if he called my phone And told me that line I’d have told him hell no, but she didn’t and even had plans to laugh when confronted on the red carpet and say how she was in on it. No more lies to cover her this time.
I think most sane people would see that comment as awful and at the very least, vaguely (if not flat out) racist, no matter who said it.
Sadly, ultimately Taylor will get a pass on all of this and her next album will be a #1 hit.
Eternal- Swift honestly didn’t sound happy as Skittles to me on the call. There were a lot is signs that she was trying to be cool about it but had mixed feelings. I can believe she just isn’t good at sorting things out on the spot, and Kanye isn’t good at picking up on nuances. So they both were interpreting things very differently and neither was trying to deceive the other. As somebody said somewhere, “What we have here is a failure to communicate.”
Kim needs to post the whole call and especially needs to send a copy now to Swift (as should have been done at the time if they were so concerned about proof of anything). If Kim were really interested in defending Kanye rather than her show’s ratings, she would have done that months ago.
If I were Kanye, I would be wondering what else Kim has in her archives about me and how she intends to use it some day. But maybe he’s way too trusting. Kim’s behavior in all this is disturbing, she is definitely trying to promote more conflict as well as publicity for herself. I suspect this is another misstep for her, just as her rush to divorce in her 72 day marriage generated a lot of dislike for her that she didn’t anticipate. Once the dust settles and people get over the feeding frenzy and start thinking things through more carefully, Kim may not look so good.

I just listened to her 2010 Grammy performance. She was off-pitch, flat, out of breath, really sounded like a 10 year old Amateur. Then when Stevie Nicks came out and they sang together, she was all showy, and swinging her head and arms around and hit such flat notes that Stevie kept looking over at her!!! It’s very funny!! Taylor has terrible control of her voice, she needs to stop with this PR nonsense and go take some voice lessons!!!

I received an award at work! I was VERY excited to have been chosen. While accepting my award, a co worker jumped up beside me, grabbed my mic, and told everyone there how I was not as deserving as someone else.
Back and forth it went. He even used my name when he was frustrated about his own work, when I had absolutely nothing to do with it (see- kayne’s SNL rant).
He called me, and I basically used platitudes to deal with him, knowing how unstable he is (see Kanye’s extremely public rants about everything- on ellen, in concert, on twitter).
When faced with actually having to deal with his erratic behaviour via phone, I told him what he wanted to hear- based on the YEARS of dealing with the instability, both in public and behind the scenes.

Nothing in that phone call indicated that she was uncomfortable. She was specific with friendly references to their repaired acquaintanceship. She’s a professional dealing with another professional being recorded in a professional setting. He didn’t call her personal home line but a management number, which is what he mentions at the beginning of the recording when he said he tried to use her Nashville # but it wasn’t working, and she mumbled someone. So in other words, when someone asks your permission to use certain information and we are ALL grown you can’t just lie and say ok. She is the Queen of Suing but she’s going to just roll over and say ok when it is a lie because she is so scared of the angry black man. No that excuses her behavior when it is unacceptable. Lastly, all of this happened because of her reaction at the Grammy’s. She knew she talked to him regarding the song but decided to do a speech using the angry black man archetype. That’ s just wrong.

I think she suffers from being overly loved. I noticed that a lot in my kids’ school. Many children are overly loved and entitled. Kanye hasn’t done anything with all his footage yet and from what he’s previously said he doesn’t even know what exactly it’s for yet, so he won’t have sent her a release prior to receiving the lawyers letter. Thus she had to have known she was being recorded.

Regardless of what team you’re on – I think it’s INCREDIBLY sketchy to record someone without their knowledge. It might be legal in some states, but my god – that doesn’t make it ‘okay’. Just… as a decent human, that’s not something you do.
I post a decent amount in defense of Taylor, but honestly, I’m not a giant fan. I have mixed feelings about her, though they’re mainly positive. I don’t think she’s a saint, I don’t think she’s 100% innocent because – news flash, nobody ever is.
I think that Kanye really thought he was doing something nice by calling – and technically he was – but I don’t think either party have handled this well. I think that there’s a good chance some lyrics got changed, and from her conversation it sounded like her saying ‘go ahead and tell your story the way you felt it’ but that doesn’t mean she wouldn’t tell it as it happened to her.
I also tend to think Kim is clearly benefiting from this attention – that chick thrives off of this stuff. Maybe her intentions were good when it came to recording stuff in an effort to keep Kanye safe, or whatever. But nothing she does is altruistic. I think largely, she sees another celebrity getting more heat than she is, and she jumps on that train in an attempt to keep the attention on someone else so it doesn’t shift back to hating on the K-train too soon.
I have no use for Katy Perry. She supposedly has a great raw voice – but she seems like a complete moron. If she focused more on making music – and better music than the Olympic song, and that god-awful “This is How We Do” – and dropped the offensive imagery she keeps using in her videos – maybe I’d start to take her more seriously. Because it seems like lately she’s just waiting in the wings for drama to start. She’s not even doing it herself – she’s riding on the coattails of people (Diplo, Calvin, etc) to do her dirty work for her. I think that’s just so incredibly pitiful. Why would anyone want to live like that – just waiting for people to mess up around you? I will give her credit on the gif selection, even if I don’t agree with her having to pop her two cents into it.
As far as Taylor goes – lord. I’m not on the bandwagon of thinking she has no real friends, or that she’s the most bland of vanilla boringness. I think she probably does have a few very tight-knit friends, and maybe they’re not all celebrities. I think it would be incredibly hard maintaining real friendships with that kind of level of fame – look at people like JBeibs – he’s surrounded with yes-men disguised as family and friends. I also don’t think it’s fair to jump on her for how many people she’s dated, or for her wanting credit for a song she did write. For all we know they agreed to reveal the writing sometime after the song was released. I honestly don’t think I’d have ever pursued legal action in this matter if I were her though. It doesn’t help. The damage was done already, and suing isn’t going to fix that. I think it’d be in her best interest to just go about her summer – enjoy hanging around with TH, maybe get another kitten or something. Just keep busy, and do positive things. I understand how she’s got some conflicting feelings about feminism – when I was in my Jr High years I didn’t want to be considered one. I wanted to be liked by guys, and for the longest time the only kinds of feminism I saw were depicted in a terrible light. The older I get, the stronger my feelings have gotten in terms of how much women have to fight to get ahead, how much we have to do to just be considered. I think that there would have had to have been a point where I was sending mixed messages just like Taylor, but luckily I wasn’t in the public eye.
I actually think Katy Perry has handled things right. She’s been dropping clues for years that T Swift isn’t the pristine princess she or the media claims her to be. But nothing too extreme. Nothing like a song about her enemy anyway. A few retweets or a quick comment when Katy’s understanding of Taylor is corroborated isn’t that bad. She’s earned it after that Taylor made a posturing video with her friend army.

@LB. Taylor’s influence has long been bolstered by her twitter fan base. Wynonna Judd learned this the hard way back in 2009 when she had to roll back her comments & issue an apology. No doubt, this has influenced Katy and many others in the industry.

I somewhat disagree with a lot of your points one being Katy Perry is a loser for ‘riding’ other’s gossip coat tails. I think for a lot of people enjoying this downfall of Swift they feel like she’s been metaphorically ‘burying’ people for years.
You can’t say anything bad about Swift. If she sings a song about you you have to smile and take it. If you counter her parts and refute and argue you’re labeled a loser like Calvin. She’s sweet Apple pie America and she’s allowed to do anything to anyone else but don’t dare sneeze too hard in her direction or she’ll pen a feminist think piece agaibst you. But that wasn’t even the part I wanted to disagree with. The recording. Realistically business and pleasure mixes a lot together in the celebrity world. One – the Kardashians are well known reality stars and doing business with any member of the family and expecting NOT to be recorded seems naive at best. Two – perhaps Kanye was afraid Swift would go back on her word and claim she never gave him any approval for the song and that is why he, rightfully, recorded her. Three – whether it’s for a documentary, reality show, or what have you a lot of people record phone conversations when they feel they’ll need to prove something later and in a case like this even if the law was against them, which it doesn’t seem to be, I could see the benefit of leaking the video and putting Swift in a position where she’s too scared to sue.
I’m cool with disagreement, side-eye. I’m not expecting everyone to just take what I write as law or anything. I just felt like putting my two-cents in like everyone else – and while I don’t hate TS, I do see where she can be called out, and sometimes it’s completely fair. Like I said, I think she made a dumb move with this one.
I do think a lot of the songs that are CLEARLY about someone specific aren’t always that cut and dry. I think that it’s 100% possible that people read into them way more than it was intended. Some of them are blind items, but some of them really seem to be reaching, ya know? Honestly, a lot of her songs that are about people aren’t really as bad as people make them out to be. There are a few specific things thrown in – but what band/musician doesn’t have a bunch of songs that are inspired by a specific person or situation. Maybe she’s more blunt about it, but most music seems to genuinely be based on personal experience, and almost ever time I look up the meaning of a song I like, there’s a little blurb about how it can go back to an ex-girlfriend or boyfriend, or a friend that isn’t their friend anymore, or what have you. I don’t know if some of it is based on the exposure she gets, or what. But it’s not something that’s only happening on her records.
I think Calvin was being labeled a loser before TS, honestly. I remember the posts over the Rita Ora thing were mixed – a lot of people were calling him out, some people agreed with him. Personally, I think he was cutting his nose off to spite his face in that situation. Not letting her release the songs didn’t help him financially either – they spent a good deal of time working on those songs – so he’s really in the negatives as far as man hours go for songs that didn’t get released. I think it was soooo dumb even just from a business perspective. With the car crash – people were starting to call him out again for how sketchy that was, and how he seemed to have a giant ego since he didn’t want to stay unless he had a private room. I was mixed on that one – if I were a celebrity, I’d want a private room as well. But if I couldn’t get one, I’d just want to make sure that the nursing staff was discrete when it came to discussing my health. Legally, they can’t go off spouting his medical history anyway. He seems like a man who really really has a problem with ego. I don’t know if it’s tied into recreating himself, or what. Maybe he’s insecure, but he seems to REALLY get up in arms over everything, even when it’s something that is minimal. I guess people say the same about Swift – I think he’s just more vocal about doing it himself instead of making statements through a team – he seems far more driven by emotion than she does.
The Kardashian’s ARE reality stars, and nobody can escape that. But did she even know Kim was on the call too? I would assume that Kanye has cameras following him alone far less often than the rest of the Klan. I understand that business mixes with pleasure, but when someone’s making what seemed like a pretty spontaneous call, I can see why she wouldn’t think she was being recorded. I know it’s not legally necessary in some states, but a quick “hey I’m recording this” would just be an ethical thing to do. OR OR – if he was concerned about all of this – he could have had someone send off a document to her legal team for her to sign, stating that she had been warned of the song – if he was in fact worried enough to record her as proof. We’re assuming it was recorded to cover his butt later if she claimed it didn’t happen – which would involve him assuming she would in fact do that. Email off a form – or hell – send a quick text after the call saying “thanks for taking some time to discuss the song with me- I’m glad you’re on board with the lyrics” just to have a paper trail. She’d likely have shot back a text that confirmed that. I just think that the recording – released the way that it was released is suspect. It was done on snapchat of all things – again, profit for Kim. Beyond that, it was done in snippets. We don’t know what was or wasn’t discussed on the parts that were clipped out.
Regardless of what team you’re on – I think it’s INCREDIBLY sketchy to not voice your complaints with the song to the artist himself, but instead go on the NATIONAL stage that is the Grammys, say a call never took place, grandstand under the guise of feminism, and then sit back and watch as the media, your fans, and the general public dog/trash/call Kanye a liar. Nevermind the fact that she has backtracked, and change her story countless times to hang onto the shreds of her victim identity. That screams someone who is cold, calculating, vindictive, mean, immature, and all around a nasty person. Not to mention highly unethical. Just… as a decent human, that’s not something you do.
Sorry if it feels snarky, but I just don’t get how your can feel generally positive about Taylor in light of all that. And that’s just the one incident. Does she have good qualities? I guess, but that starts to look suspect when you pull stunts like this.

Lynnie – it’s fine. I know I’m not in the majority opinion on this, and I get why people hate Taylor. I do think that a lot of the hate she is getting and that Kanye is getting is insane though. It’s just ridiculous.
She didn’t say that the call never happened, did she? Wasn’t it that the call wasn’t to discuss the lyrics. It was over an hour long call, and Kim’s only released a couple snippets of it. I don’t know what happened during the majority of that call. Maybe Kanye talked about the lyrics the whole time, maybe he didn’t. If she didn’t hear all of the lyrics, or the lyrics as they were recorded, she SHOULD have just said “The call we had did not include the lyrics as they were recorded” and called it a day. She made a dumb move with that one, and she’s paying for it. And maybe I missed something – I completely could have. But there are a lot of people posting saying that she denied the call ever happened period, but I haven’t read anything supporting that, so I’m only going with what I have personally read.
I looked at a transcript from her speech – I really REALLY don’t see anything horrible about that. In the released recordings she told Kanye to write the lyrics how the story went for him – how he felt. Just because she said go ahead, write that line because you didn’t know me, and at that time that’s what you felt doesn’t mean that she is accepting his version as fact. Kanye DIDN’T make her famous. The girl was already successful. The speech could just as easily be about Calvin when it comes to undercutting her work/taking credit. I don’t see it as a denial or a backtrack. After the Kanye stage thing back in… I don’t even know 2009? Somewhere in there – I believe that it probably did make her focus on work. Nothing in that speech (from the transcript I read) seems false.
Kanye entertains me at times – some of his music is great- but for the most part, the man is off the rails. From what I PERSONALLY have read/watched in regards to him – he does have a tendency to spout a lot of angry non-sense. Sometimes he’s right. Sometimes he’s not. I personally recall him saying that he had ‘baby tourrettes’ that makes him ‘tell the truth’ in the past. I’ve watched him go off on Amber, and Wiz, and multiple other people. He has had feuds with just as many people as Taylor does. I see a lot of “nobody can make comments about Taylor without her lashing out” and that sort of thing. This also describes Kanye. He can’t let things go. He has a history of misogynistic actions and lyrics. He’s tweeted his support for Bill Cosby. So maybe I’m biased about Kanye the same way other people are biased about Taylor. I do think a lot of the hate he is getting is in relation to how much people hate the K-Klan, and because Kim was involved in the story. Really – even around here, almost every post up until recently Kim could have said the sky was blue and people would have called her a liar. If she said she had a salad, people would have said it was clearly scripted for the show. I think some of that hate he’s getting is honestly directly related to the level of hate people have for the Kardashian’s.
At the end of the day – a call was made. Some or all of the lyrics were discussed and she hasn’t handled this situation well at all. She absolutely needs to apologize about a lot of things. I don’t think that that means that Kanye hasn’t been a jerk to her at times too – maybe this song was an attempt to just clear the air. Who knows.

The appropriate thing to do would have been to give Swift a copy of the recording for her own records, since it was a professional matter. That would have prevented all the he said she said nonsense.
It was very inappropriate to hold on to the recording until Kim needed a ratings bump months later and then post 10 second excerpts on SnapChat. If he had used the material in a documentary, he would have obtained a release from her to use it.
If Kim continues to post snippets, we know she is editing something out. Post the whole stupid thing in its entirety on your website, Kim, and let people decide for themselves.
The one thing I really feel for Taylor on is KW obsession with her over the years. I’m sure it’s beyond annoying. Overall she did a stand up job of ignoring it. KW loves power and money. Taylor has lots of both and he can’t seem to get enough of her! I have only seen tiny clips of his creepy date rape looking music video, but refuse to watch it because it just doesn’t seem legal that you can get exact wax creations of a real life person, then video them naked?!?!?! She might persuade the authorities to pursue a criminal charge against Kanye and/or Kim. Or she might not – that isn’t her call to make.
She can decide herself whether or not to pursue a civil claim. But as a lawyer my question is, what loss has TW suffered that is compensable in damages? I can only speak for the situation in England/Wales, but in my jurisdiction she would get zero damages for damage to her reputation – the rationale being that if she lied, she has no right to a reputation as a person who didn’t lie. She might get nominal damages for invasion of privacy, but really very little for one phone call. If the court accepted that she was using her right to privacy as a cloak for libelling someone and getting away with it, she would probably get nominal damages – like £1.

I was talking to my cousin (who is a lawyer) last night and she said that the two party laws here in California are very strict. As in people have successfully argued that they had the expectation of privacy even in a public place…..A comment on Gawker also said something similar about California being one of the strictest states when it came to wiretapping.

I’ve defended Taylor, as petty as she can be, in the past but in this case I feel like there are no winners. She looks petty and like a liar even if she is telling the truth because she implied she wasn’t aware of any of the lyrics. Kim did something illegal and messed up. Kanye is misogynistic as always. Legally it would be a long and expensive court case. For a PR perspective it’s the worst case scenarios for her, it makes her look really bad and even more sketchy than she looks now but this is always the victim Taylor so I think she’ll sue. Exactly. People claiming that one-party consent laws are stronger than two-party consent laws are full of it. Even in federal or interstate cases, if one of the recorded parties is in California, then the judges usually side with California laws because of their strength.

Its not a theory its the law. Taylor is seen on video talking to other people (Rubin for one) while on speaker with Kanye. That’s not a theory you can see it ON VIDEO. Therefore she had no expectation of privacy. Taylor was most likely in NY when the call was made. Again not a theory. Therefore the Cali rule of two party consent does not apply because there were other people on the call and often times when both parties reside in different state the one party rule seems to have prevailed in court.
but, according to my husband, she still COULD have a case because at no point is Kim seen being involved in the conversation. Kanye could use the recording, but not Kim, since she wasn’t a party in the conversation. The laws are very murky. Where she COULD have a case is in the releasing of the conversation without a signed release. She wasn’t aware she was going to be involved in “Keeping Up with the Kardashians” and if she never signed a release for her voice to appear on the show, she COULD have a case there. But in my opinion, she needs to walk away and lay low for a bit and not concern herself with a lawsuit that would only serve to make this whole thing even more petty.
They did not release it on the show at all so that doesn’t apply either. They released it on a public medium probably because their lawyers advised them NOT to use it on the show because of that very reason. Your husband is right but that’s not how it was released. It’s like I said yesterday, I don’t think half of these defenses are actual in defense of Taylor Swift but more along the lines of opposite Kanye West. I didn’t know any of Taylor’s earliest songs, so yesterday I decided to go on YouTube and educate myself. Well, I expected those songs to be cheesy and annoying, but damn! Anyway, I can’t really be surprised at Taylor’s success among teenagers. In her lyrics, she deals with familiar issues (friendship, jealousy, the first heartbreaks etc..) in a very petty, “high-school drama” way. She used to present herself with a squeaky-clean image of the pretty, yet still goofy and awkward blonde, so that girls wouldn’t be jealous of her and could still relate. Nice touch.
After a few visualisations, I got tired soon looking at all her silly gestures and smirks. And even now, after 1989, she is still as immature and juvenile as then. Her music video all look like chapters of the Taylor Swift’s Perfect Fairy tale, where she’s either the invincible warrior, kicking ass in stilettos and body-tight latex, or the queen of the castle, moving her sceptre around and throwing curses at all the boys who dare treat her any less good than what she thinks she deserves.
Taylor is now 27, she has successfully navigated from country to pop princess. Those antics are ridiculous. It’s about time she changed her narrative. She’s not credible nor appealing anymore, so she needs to re-invent herself into a new character. I am sure, like Lainey and so many other observers has said, that this is not the end of Swifty. But, still, she could just have reached the highest peak in her career and never be able to climb back, so she must be very careful how she comes back after the summer.

Wouldnt it just make more sense to have said something like “I did not like the song/appreciate the song/approve of it but was too afraid to hurt his feelings or whatever so I said to go ahead and use it or whatever. Oh wait, for some reason Kim felt like she also needed to tape the phone conversation and both she and Kanye made sure he lured Taylor in with how he has a responsibility to her as a friend (roll eyes) and how they need to build trust … its all gross and premeditated. I know so many guys who talk like that to seduce girls and then treat them disrespectfully afterwards. The next phase is gaslighting which is blaming the victim for questioning why actions and words don’t quite align. She tells him he is so sweet etc. because that’s what girls do when they are misguided to believe the other party has a right to malign them because they are more powerful or more cool AND there will be repercussions if they don’t go along. All of it is emotionally manipulative and Kanye is such an a**hole. He arrogantly stole Taylor Swift’s moment at the VMA’s in 2009 and people can say she has acted like the victim but, she was only 20 years old and ever since, Kanye west has passively aggressively and aggressively kept her in his world because he has an obsession, not with her but with something I don’t even pretend to understand. “I made that bitch famous??” seriously?? Dude, work on your lyrics if you don’t “… want to do rap that makes people feel bad.” In context, these lyrics suck and at the very least are so unenlightened and unnecessary. Taylor’s voice on that conversation sounds like someone who is trying to act cool and go along with something she hasn’t processed yet. I’m not a Taylor Swift fan but, I really can’t stand what Kanye is doing with the help of Kim.
Please Taylor knew exactly what she was doing let’s not try to make a victim out of someone who not one.
The fact that when in the recording studio Kanye recorda everything includingincluding phone calls is a known fact.
Not to mention is Taylor was unsure of thing she would have asked to hear the song before it was released. Which she didn’t and sign off on what ever he did.
We don’t really know what he or she said for most of the phone call. Kim posted it on a platform that only allows 10 second videos. The phone call might have been as long as an hour, but it certainly was much longer than what has been posted.
Kim could have posted it in its entirety elsewhere. The fact that she didn’t is suspicious in itself. This is the same woman who has edited and faked scenes months later to smear other people on her show and uses leaks of baseless tumors for the same purpose. We have no good reason to believe that we know even a fraction of the whole story. We only know the spin given repeatedly by Kim, a pathological liar. It’s working only because enough people don’t like Taylor Swift and are gleeful about “taking her down” for her sins. (Honestly, the Internet is such a childish mean girls food fight these days… ). But that’s not a good enough reason for grownups to stop applying logic to the situation.
I think every party has acted wrong, immature, and it’s gotten out of hand. It’s like Mean Girls times ten. They all have damaged theirselves, everyone’s behavior encourages others to call people out, make fun of them, use Social Media as a way to verbally assault or ruin someone for what popularity and monetary gain. Old Hollywood albeit not pristine was more discreet all this as a humanis sickening to me and why I encourage my friends to be smart what you say, do or post. Two wrongs don’t make a right, people have committed suicide over Social Media taunts and backlashes there was better ways for all parties to act. Damage is done and they all need to act like grown ups use their Social Media for good not to attack each other same people who don’t want to be attacked always attacking others. I feel sorry for them all empty cruel hearted people.

Taylor really just needs to sit down for a good long time and disengage from this mess. No more scheming how to get back at Kanye/Kim, whom she should never be “friends” with again, which would just be disingenuous. She should start writing her next album called “Regrets.” It’ll be her image-changing contrition album.
This is going to hurt Kanye more than Taylor because Kim released this. Music industry people may not like Taylor Swift but people really won’t like what Kim did on her show. Most industry people are like Taylor anyway and that is why she is successful.
No its not Kanye recording is nothing new by the music industry or the public. People already know what Kim and family are about, this is nothing new.
lol if kanye was going to be damaged he would have NO career at this point. Fact is a lot of people like his talent. He is the same as taylor in that way…few people genuinely like them but they like their work. Just look at all the people (past coworkers, exes, former squad members, former friends) that have clearly sided with Kimye. This isn’t going to ruin kanye…this is going to hurt taylor the most. Esp on the heels of a fake romance and Calvin not rolling over for her. People are over the girl and kim is smart she knew what she was doing.
I absolutely HATE Tom Hiddleston. Not because he has a girlfriend that I don’t approve of, not because he’s being a tool, but because I am interested in what he is up to, which means I actively find myself reading this crap.
I live a very Kanye/Kardashian/Swift free lifestyle, which I’ve enjoyed immensely until now. I would have skipped these stories in a hot minute if there wasn’t the Hiddles angle, but because of my Dragonfly master, I am clicking on all of this crap, and actually have opinions.

This is not the thing that will finish Taylor, people! But it may show the beginning of the end. The public backlash happens because she has stuck in the same narrative / image / creative corner of the “good girl” for TOO LONG. Taylor shares this same formula with Britney before her breakdown and that’s when the public starts to get tired of her. The breakdown changes the narrative and it’s the first time Britney is “the victim”. Except Taylor already used this to death as well. Now she stucks and that narrative is reaching its shelf life. Madonna can stay relevant for so long because she can re-invent the wheel; and Kim K is the digital-age Madonna (not Gaga who frankly uses all her tricks AT ONCE). I’m curious on what Taylore can do next long-term because getting out of this ain’t solve her problems. One can argue a hit song / album is all it takes BUT don’t forget, she mixes her personal life and professional artwork to the point they are one. It has to be a new package that people can believe inside out that was transitioned from this juvenile image she has – especially with these new skeletons in her closet YET is an exciting narative that can continue its own course. Will be a hard one to crack.
I don’t agree about it being unethical, wrong, or even all that immature for Kimye to release this without Taylor’s consent. Attention-seeking? Definitely. But when someone lies or implies something untrue about you in public to make themselves look good and throw you under the bus, and people don’t believe you (in Kim’s case people didn’t believe her because she’s a known liar and Kanye is known for his delusions) it doesn’t seem wrong to publicly release a recording that shows that they’re not being totally honest.
You can’t offer as evidence something that was aquired by illegal means.
Why wait five months to release it? If you’re trying to protect yourself from someone’s lies, why wait five months?
According to California Law, it is illegal to record a telephone conversation without both parties consent. Since Kanye and Kim broke the law, that makes it unethical. If I were Taylor, I would sue.
Except what makes the law murky is Taylor consented to talking to a room full of producers. You even hear other people talk on the call. She has no legs on this case.
TS acknowledged sometime this year that she was concerned about being over exposed, and I think she was taking a break to somehow tweek her image into something slightly more mature, maybe with a new direction in her music. I also think being involved with a more mature (sic) man who is in a different entertainment field was part of the plan. Well it’s going to be interesting to see how that’s going to play out now since the Summer of the Backlash.
So does that mean Anna Wintour won’t be inviting any of these embarrassing people to next year’s Met Gala?

I’m on Team No One. I’ve always thought Taylor was/is a fos Mean Girl under the guise of “America’s Sweetheart”. Sadly i have a friend who refuses to see this, because “she’s so good to her fans”. I may not be a Kardashian fan but I’ve always known clearly and precisely what they are. AND if Taylor is stupid enough to open up the can of worms that is legal action then that gives the Kardashian attorneys permission to thoroughly assassinate her character.

For the life of me I can’t understand why everyone seems to have their panties in a wad talking about “ruined careers” and whatnot. Could either one of them have handled the situation differently? Of course. But bottom line for me is I like a lot of his music, I like a lot of her music. If I like it, I will spend money on it, if I don’t I won’t. Neither of them is obligated to be someone I want to hang out with and be my new bff. I’m not going to lunch with them. And, honestly, neither of them that I’m aware of has done anything bad enough that would make me boycott them or refuse to buy music I enjoy. As far as ruined careers, I certainly doubt that. A year from now, hell a month from now, this squabble won’t even be on the radar for most people.
