Donald Trump found liable for sexual abuse & defamation of E. Jean Carroll

In 2019, E. Jean Carroll covered an issue of New York Magazine to promote and excerpt a book she had written. In the book, she described at least two sexual assaults, one by Les Moonves (then head of CBS) and one by Donald Trump. Carroll described being raped by Trump in the dressing room of Bergdorf Goodman in the 1990s. At the time, she told friends what had happened but she didn’t go to the police or even to Bergdorf’s security. Even then, she knew that Trump would try to bury her. In 2019, Trump dismissed Carroll’s claim the same way he dismissed so many of the other women he preyed on, assaulted, raped and harassed: he called Carroll a liar and said she wasn’t attractive enough to be assaulted, and she wasn’t “his type.” Well, Carroll sued him in civil court for assault, rape and defamation after that. The civil trial had been happening for weeks, and the case went to the jury on Tuesday. It only took the jury three hours to come back with a unanimous verdict: Trump is liable for sexual abuse and defamation.

A Manhattan jury on Tuesday found former President Donald J. Trump liable for the sexual abuse and defamation of the magazine writer E. Jean Carroll and awarded her $5 million in damages in a widely watched civil trial that sought to apply the accountability of the #MeToo era to a dominant political figure.

The federal jury of six men and three women found that Mr. Trump, 76, defamed Ms. Carroll when he posted a statement on his Truth Social website in October, calling her case “a complete con job” and “a Hoax and a lie.”

The jury, in returning its verdict shortly after 3 p.m. said Ms. Carroll had not proved, by a preponderance of the evidence, that Mr. Trump had raped her, as she had long claimed.

Ms. Carroll sued the former president last year, accusing him of shoving her against a wall and raping her in a dressing room the luxury department store Bergdorf Goodman in Manhattan, in the mid 1990s.

Although more than a dozen women have accused Mr. Trump of sexual misconduct over the years, allegations he has always denied, Ms. Carroll’s case is the first of those claims to be successfully tested before a jury.

The jury also found that Ms. Carroll had proved that she was injured as a result of Trump’s publication of his denial of her accusations on his Truth Social account in October 2022. The jury determined that Ms. Carroll had proved, by clear and convincing evidence, that Mr. Trump knew his statement was false when he said her accusation was a hoax, a legal standard known as “actual malice.”

One grotesque part of this trial was the introduction of Trump’s filmed deposition, where he mistook a photo of Carroll from the 1990s as Marla Maples, proving that Carroll actually was his type (blonde, beautiful, leggy). In another part of his deposition, he was asked about the Access Hollywood tape, where Trump told Billy Bush: “When you’re a star, they let you do it. You can do anything, grab them by the p-ssy. You can do anything.” When Trump was asked if that was what he said, Trump replied: “Well, historically, that’s true with stars. If you look over the last million years, I guess that’s been largely true. Unfortunately or fortunately.” Unfortunately or fortunately.

Anyway, I’m extremely proud of E. Jean Carroll and I hope she’s safe and secure. I hope she’s surrounded by friends and family and that she’s protecting herself. She knew that suing Trump would be a long, arduous process and it was, but she stuck with it and found a sliver of justice. It’s not even close to “enough,” but it’s something.

        He will try to get the judgement reduced on appeal, but probably won’t win. If he doesn’t pay, authorities have the right to garnish his wages, levee his bank accounts, or seize property.

      I know he doesn’t pay, but since her lawyers will be getting a chunk of it, I’m assuming they will sue for payment and ask for legal costs as well. She’ll get some of it someday, and in the meanwhile we can rejoice in the fact there was a judgment against him. I hate what happened to her and all of the other women, but holding him accountable means something. It means a lot to me.

    The jurors were anonymous and the judge told them they would be smart to not identify themselves.

    Thanks to Ms. Carroll, her lawyer Roberta Kaplan, Lisa Birnbach (amI the only one who remembers “The Preppy Handbook?”) and Carol Martin for what they did to help make this happen.

    I was worried he would slither out of consequences yet again and was thrilled she got such a substantial and fast verdict. The jury came up with the $5 million because she didn’t even request a specific amount. E. Jean is an absolute badass.

    CNN should not go through with their Trump townhall tonight. Handing a prime time slot to a sexual predator with dozens of arraigninments is really horrible. If the townhall goes through I hope everyone asks about him about his legal cases and gets him to spin out.

      If people ask such questions at the Town Hall, Trump will likely stalk offstage, his ego couldn’t take it. I agree CNN made a terrible choice, there are other Republicans in the race that could use the exposure and wouldn’t attempt to corrupt and overthrow the country, if elected. I don’t see why they would highlight and promote Trump over other conservatives, except he is better for the news cycle.

      I’m sure CNN and TFG will vet the questions to make sure nobody asks him anything he doesn’t like. I don’t know much about the moderator Collins other than that she used to work for the Daily Caller (founded by Tucker Carlson).

      I will not be watching, and I hope others won’t give them the ratings boost they are so desperate for, either.

        Yes, in CNN’s quest to be Fox Lite, they may very well vet the questions. Since he’s at the top of the polls, they’re seeking viewer numbers and wanting future visits from the front runner. I’d rather light my hair on fire than watch, the recaps will do.

      He’ll send out an appeal, and poor people living in trailer parks will send their last five dollars to Trump. I reconnected with my childhood best friend when my father passed–as she knew him from childhood as well. We fell out over January 6th, when she wouldn’t shut up to me about it being “really antifa.” She jumped hard on the Trump train, so far that she refused to get vaccinated, and gave up her job in health care (as a single, divorced mother) and is now living on her retirement savings. (I’m beyond shocked). I sent her some money, in light of our long time friendship (and that money will come with a major “come to Jesus” talk about her finances). I say all this with a disheartening thought. I’m pretty sure she spent the money I sent on much-needed living expenses. But if she got an appeal from Trump right now to “help him in his persecution”, I’m sure she should send him money, even now. This means I can’t send her anything else, because of the chance it might end up in his pockets, This smart, educated woman would choose to support Trump over her own children. I don’t understand it. I don’t understand the power of the brainwashing.

      But I’m certain that if he has to pay 5 million dollars, poor and working class Trump supporters will pay the bill, at the expense of their own health, their own children, and their own well being.

I ended a friendship that started in grade school and was close for 50+ years for the same reason. Over 50% of rethuglicans said they’d vote for him even if convicted of crimes. I just don’t get it. I’ve been listening to the latest Pod Save America & apparently the judge gave trump TWO chances to testify; the second because he was over in Scotland or somewhere regarding his golf course & he said he couldn’t stay long because he had to get back to NYC to testify, so the judge said, OK, testify. He still didn’t.

Jean Carroll is a badass for toughing this out, but sadly, I think we all know damn well that her experience was far from unique. I’ve said it before and I’ll say it again: I don’t think Trump has ever had consensual sexual experience that didn’t involve a monetary transaction. Hell, even the ones he paid for probably turned nonconsensual before it was over.

    I hope both Ms. Carroll and the jury will be safe. I wouldn’t put anything past the MAGAts.

      I think about Christine Blasey Ford a lot, and the image of her holding up her hand to swear in. She knew it would bring her nothing but grief and that it wouldn’t change anything, but it was the right thing to do so she did it. We all know who he is now, even if to some people it didn’t matter.
      I don’t know much about E Jean Carroll, but with all the maga crazies, she was kick ass brave to pursue this. And what a joy to see her win.
      I was too young to fully understand what Anita Hill went through, but in recent years have learned more about all of it. She really did pave the way for many.

    Also, I keep thinking about the jury deciding rape (but yes to “sexual battery”) couldn’t be proved because E. Jean said (under oath) she was unable to tell if he penetrated her with his fingers or genitalia.

    Of course, I wouldn’t want to body shame another person but given it’s Donald, I can’t stop giggling. How embarrassing would that revelation be for a normal person? I say a normal person because it’s Donald and he’s most likely telling (and believing) every lie he can think of to himself so he feels no shame.

    TFG is loyal to no one; he would throw his mother/father, and or kids under the bus if it benefited him. Listening to his own testimony in that deposition – he doubled down on his words from the Access Hollywood tape because that is LITERALLY how he feels about women. I have zero doubt there are many other women he sexually abused/raped who never came forward. We know of at least 25 plus that have. Who knows? This case may give them the strength to do so.

    Kudos to E. Jean Carroll for having the strength to see this through!!
