Prince Harry is involved in so many lawsuits against the British tabloids, even I get confused. This update is about Harry’s lawsuit against the Sun, which is part of News Group Newspapers, Rupert Murdoch’s media empire in the UK. Harry is alleging the same thing across the board, which is that all of these media outlets hacked his phones, spied on him, gathered information about him illegally, stalked and harassed his girlfriends and friends, blagged, and on and on. Harry’s case against the Sun was of particular interest because Harry revealed that the Sun had secretly paid Prince William a seven-figure settlement in 2020, and that QEII had some kind of arrangement with the tabloids to not pursue legal action circa 2010-12. Well, here’s the update:
The Duke of Sussex’s claim over allegations of unlawful information gathering against the publisher of the Sun will go ahead to a trial, after a high court ruling. Harry, 38, alleges he was targeted by journalists and private investigators working for News Group Newspapers (NGN), publisher of the Sun and the now-defunct News Of The World, and has launched a claim for damages.
At a hearing in April, NGN asked Mr Justice Fancourt to throw out the duke’s case, arguing it was brought too late because he should have known sooner he had a potential claim. In a ruling on Thursday, the judge concluded that Harry could not bring his claim relating to phone hacking, but that his claim over other allegations – including use of private investigators – should go ahead to a trial, which is due to take place in January next year.
The judge also refused to allow the duke to rely on an alleged “secret agreement” between the royal family and senior executives working for media mogul Rupert Murdoch as part of his claim.
In his written ruling, the judge concluded: “I am satisfied that there is no reasonable prospect of the duke proving at trial that he did not know and could not with reasonable diligence have discovered facts that would show that he had a worthwhile claim for voicemail interception in relation to each of the News Of The World and the Sun. He already knew that in relation to the News Of The World, and he could easily have found out by making basic inquiries that he was likely to have a similar claim in relation to articles published by the Sun.”
Harry’s lawyers previously argued that NGN’s challenge to his claim was an attempt to go behind the alleged “secret agreement”, between the royal family as an institution and the publisher, which the duke was told of in 2012. Fancourt said in his ruling that the duke had not “provided any evidence from those in the palace who would have been aware of a secret agreement if there was one”.
At a hearing in London earlier this month, lawyers for the duke said there was evidence to support the existence of the agreement, including emails between senior executives at the Rupert Murdoch-owned parent companies of NGN and palace staff in 2017 and 2018. David Sherborne, for Harry, also said in written arguments the fact the Prince of Wales settled a claim against NGN “for a very large sum of money” in 2020 also “supports the contention that there was a secret agreement in place”.

While I’m glad Harry’s case will go to trial – and this one is a solo venture, he’s not part of a case with multiple plaintiffs on this one – it does feel like the judge is kneecapping Harry’s lawsuit significantly. Harry’s argument was always: back then, in 2010-12, I didn’t ask questions, I did as I was told, and I was told that the palace had an agreement with NGN to avoid litigation and quietly settle. The judge is saying that Harry can’t make that argument because he doesn’t have evidence of a secret palace agreement. Like… the fact that William took a secret settlement in 2020 is the evidence. The fact that no royal before Harry openly sued the Sun for phone-hacking and criminal activities is the evidence of the secret agreement.

I’m sure he’ll take the win where he can, although the arguments against the portions that couldn’t proceed don’t make sense to me either logically. However I know logically and legally aren’t always the same. I’m glad that other media like PA, Variety, Associated Press, is leading with it goes to trial in January 2024, because the first thing I saw was from the Evening Standard saying that it was thrown out. I see the British media is going to of course spin this that way, and probably write 600 articles about it in the next 5 days instead of writing six articles about Dan Wooten.

I agree. We can’t assume this judge will abide by neutrality knowing how Murdoch has been influencing the system & current heads of government. I wonder what the judge’s explanation is for blocking harry from phone hacking when his own brother allegedly got a payout for it?!!
I think Harry is more focused on bringing attention to their corrupt behavior. I mean he could’ve sought a secret payout like his coward brother but chose to proceed knowing he’ll be against a corrupt system

Harry chose not to settle with the tabloids because he wanted to sue but the judge said its been too many years. He wanted to expose the tabloids
@theoldchick, neither do I! I’ve just been watching the evening news and what is going on here, because they have just read out the judges statement and he said that Harry was to late for the phone hacking claim!! But, William was only paid out in 2020, that’s only 3 bloody years

The Palace never denied the allegation of a pay off so even though it was thrown out it’s still a victory for Harry. It’s a matter of public record now.
Agreed. I think the main goal was to get it on record and make sure the public knows about all the shady back room dealings, pay offs and cover ups between the press and the palace.

At least there will be a trial which is the best outcome actually. The judge could have denied the charges all together.
My sentiments too. I wish the entire suit was moving forward…because yeah, the british rags are spinning it as ‘it’ was tossed out. Tossing that part basically means charles, william and their grey suits are off the hook – but at least the issue is now public record.
I honestly never looked at the “secret agreement” as crucial to the case. It was merely there to explain why H could bypass the statute of limitations. H didn’t file a lawsuit against the Sun *and* the palaces. So as long as the case moves forward, I think it’s fine. And it’s a better look than seeming to put the palaces on trial; the place for that was in the memoir, interviews, etc, and H performed well there.
Too bad they got away with the phone hacking; the ruling was also the same for Hugh Grant’s claim. Wouldn’t it be great if Harry had a decent, mature, thoughtful brother who who could say: “I’m sorry you didn’t get anything for being hacked; here’s half of my settlement. You deserve it just as much as I do.”

Except for Harry is asking for less than a mill and doing it public. Whereas William kept it secret and reportedly got millions. Nothing William did helps any members of the public suing the tabloids. In fact, it hindered them.
Yes, it’s a shame that BP has seemingly been shielded somewhat. That was an intriguing and valid part of his claim to me. Hopefully it can be further explored in a forum other than a courtroom. Otherwise Harry lives to fight another day so good for him.
NGN has to try to win on the facts of the case now, they can no longer claim that the case is irrelevant because it happened too long ago. This is a huge win for justice.

Harry will take the win, despite elements not being admissible. The heart of the case is moving forward. He’s already won in the court of public opinion. Now his lawyers have to bring it home.
I said at the beginning of Harry’s case that I was worried about the judge because of some of the comments he made on day one! I hope Harry’s barrister manages to bring up in court some little snippets as in “looking at the article dated*’*’ ‘ one has to wonder how the sun had access to this information IF as this gentleman says, he didn’t collect it through his nefarious means, what and who else was in play on those dates, leaks hacking or inside sources? Obviously we cannot know for sure, but we can, as adults form our own opinions “. I’m just worried if its a jury trial, will they mange to find unbiased people after all the shit being stirred by the UK and murdoch world press. Oooo just a thought, wonder if slime ball Wooton will be mentioned??
Even a partial victory is a victory. Harry is going to continue to make NGN squirm and that’s great.
Last point, didn’t the fact that knaph produced “private and personal emails to a court case when Megan was sueing for the printing of her letter, PROVE to the judge, that there IS an agreement, after all, how did that weasel know when to try and influence the court, why was he able to break an NDA and wasn’t he working for bullyam at the time

Yes, it’s a win. BRFCo was never going to let the palace support his assertion about the secret agreement. But by making the charge about Willy benefiting from a payoff, it’s now in people’s minds as a fact, even though the trier of fact said phone hacking charge was too old.

This is a win, Prince Harry will not be not silenced. The trial will continue to be what Leveson 2 was intended to investigate, the media lobbied to let it go away and continued their nasty behaviour in some regard.
This required boundaries to protect famous people like the prince, it may have felt impossible because of the time lapse but Harry has prevailed and it is going to trial.

Isn’t phone hacking illicit means? I guess the illegal activities of the press will still be on trial. I guess a statute of limitations on the hacking is convenient for the judge and indirectly protects the royals.
The British media are covering up for each other now that Dan Wootton has been outed living a double life. Nobody’s immune. They know that with Harry’s lawsuit they could be the next target. Go get them all Harry!
