Blake Lively & Justin Baldoni have opted out of mediation for their lawsuits

This week, Blake Lively’s lawyers sent subpoenas for Justin Baldoni’s phone records, going back two years. Blake already has extensive phone and text records from Baldoni’s publicist Jennifer Abel (which Lively’s side handed to the NYT), but they want all of Baldoni’s call and text records, and the records of producer Jamey Heath and Wayfarer Studios’ co-founder Steve Sarowitz. Blake’s lawyer promises that the records will “expose the full web of individuals who were involved in the smear campaign against Ms. Lively.” Justin Baldoni’s lawyer Bryan Freedman responded, saying: “This massive fishing expedition demonstrates that they are desperately seeking any factual basis for their provably false claims. They will find none.” Eh. I think Baldoni’s phone records will probably be turned over, and Baldoni’s side should also subpoena all of Blake and Ryan’s records too. Fair is fair. Meanwhile, this isn’t going away anytime soon – both sides have rejected an offer of mediation.

Both Blake Lively and Justin Baldoni have opted out of mediation, setting the stage for a potential courtroom showdown.

In a letter filed Thursday, Feb. 13, in New York federal court, attorneys for both sides argued that engaging in settlement talks at this stage would be “inappropriate” and “premature,” indicating that the case may ultimately go to trial.

Lively’s attorneys Mike Gottlieb and Esra Hudson issued a statement Feb. 12 saying that seeking subpoenas for Baldoni’s phone records will “expose the people, tactics and methods that have worked to ‘destroy’ and ‘bury’ [Lively’s] reputation and family over the past year.”

Earlier in the month, both legal teams appeared at a pre-trial conference to discuss Lively’s prospective request for a gag order. U.S. District Judge Lewis J. Liman cautioned both parties against litigating through the press, warning that excessive media coverage could lead to an earlier trial date, currently set for March 9, 2026.

Liman also reminded both legal teams to follow New York’s Rules of Professional Conduct, which prohibits attorneys from making statements that could unfairly influence a jury. However, the judge declined to sanction Baldoni’s attorney Bryan Freedman despite claims from Lively’s team that he made inflammatory public statements attacking the actress.

I understand why both sides are rejecting mediation right now, because both sides are still positioning themselves for a long, dirty, attritional legal battle. But… I kind of wonder if some of this will eventually go through mediation. Just because they’re rejecting it now, doesn’t mean that will always be the case. If this is really headed to trial next year, I could see how both sides might be willing to come to the table by the end of this year, simply because of the significant reputational damage happening already.

    Suggest both read Bleak House by Dickens and consider the cost in every sense of pursuing this.

  2. So the messy messy circus will continue. Maybe they should both look at the big picture. What will this do to their careers? Dragging this out in court and mud slinging on both sides doesn’t seem like a good idea to me.

      I agree Susan Collins, neither side will come out with their reputations elevated or even intact by the time this is over. Frankly I don’t know if mediation would help at this point, so much has been made public that can’t be taken back and people are getting more and more entrenched on which side they’re rooting for.

    Settle. Settle. Settle. Require NDAs when you settle, settle, settle. NO ONE wins this type of lawsuit in court. Prince Harry cleaned Murdoch’s clock and is still being portrayed as a loser AND is still getting constant negative press. The longer this drags out, the more it damages everyone involved, even people on the periphery like TS.

    I’ve blocked all content related to this duo on my social media feeds, yet they still manage to seep through. Here’s a red flag: if Nazi apologist Candace Owens is defending you, it’s probably time to reevaluate some things.

    I think they will settle but you can settle without mediation. And I don’t think it will happen for a while yet. This just keeps getting messier and messier, especially if Baldoni subpoenas Blake and Ryan’s phone records (which I think will happen) and if someone like Taylor gets dragged further into this (I don’t think they would try to subpoena any of her records, but its very possible she gets called for a deposition about that penthouse meeting.)

    I think both sides are waiting to see how public opinion goes before settling but at this point, I think a lot of the public is already tired (and a lot aren’t paying attention.)

    I’m sure both sides have lots of phone records calling the other side all possible names. They were not on good terms at the end after all. What could be so incriminating if found?

    This is so messy, but if Blake was sexually harassed and than smeared to cover it up, of course she will not settle. She shouldn’t settle.

      Totally agree. If there was sexual harassment and/or retaliation for sexual harassment, then she shouldn’t settle. By the same token, if the threat of filing SH allegations was used to hijack a movie and smear Justin then he also shouldn’t settle.

      And that is all that matters. I think she was sexually harassed and they went after her. It works, we have seen it over and over. DARVO DARVO DARVO.

        I don’t believe she was sexually harassed – after reading his lawsuit and the release of the filming footage. I did at first because of the New York Times article. I actually find her incredibly manipulative now and understand the firestorm.

        However, I may be wrong. Time will tell.

    Not a lawyer but I don’t think a judge is going to okay a blanket request for 2 years of phone records. Probably have to narrow it down to calls/texts to and from specific individuals or companies.

    Blake was given a one-day extension to amend her lawsuit. Until then nobody will settle or negotiate.

    I think that Baldoni has no choice but to go all the way. Blake has made the sort of accusation that if he is innocent, his career will never be the same do to her lies. But, on the the same token, if Baldoni has instigate this witch hunt, Blake deserves to expose him. But, being honest, I tend to believe Baldoni as of now. Too much mud in the water coming from Blake, Ryan, and Taylor. And the evidence Baldoni seems credible until I saw otherwise.

      Based on what’s come to light so far, the receipts about Taylor IMO make it seem like she’s basically been name-dropped by both sides in an attempt to further their agendas.

      As far as I can see, based on what’s been shared, she provided some feedback on something a friend worked on, met the director – and I’m sure most people in the entertainment biz would be pleased to have that connect, Blake name-dropped her in that cringey dragon text, and then allegedly said she wouldn’t ask Taylor for rights to an old song of hers for the movie unless her cut was used. Not that Taylor refused to give the rights. There’s some online ish about getting someone fired on set, but there doesn’t seem to be anything I’ve seen documented that backs it up.

      IMO Blake seemed happy to overstate Taylor’s involvement in the press tour to get Swifties to turn out but realistically at the time it was being prepped/filmed she was touring, recording a new album and starting to spend a chunk of time in Kansas City. There’s only so many hours in a day…

    Ari Emmanuel just came out on a podcast and was bullying Justin Baldoni, calling Justin “Bologna” which I found in poor taste. I’m with the poster(s above who wanted to be fair but say Blake looks less and less believable and Ryan is sketchy in all this too.
